Horstkotte, Jr. - Gemeral Manager -Chief Engineer SUBJECT: Replacement of 40 gal. water h ter at 151 Orchard Road, Orinda in connection with Job 1564A . PROBLEM: Water heater rupture after water service break by District construction crew. 2. BACKGROUND: On the 4fternoon of July 27, 1971, the water service at 151 Orchard Road was pulled out by our construction crew, which instantly released the pressure on the old water heater in the residence. The service was repaired and the water turned on, that. • evening, but the water pressure was questioned the next day. The water s again turned off and pressures checked. The next afternoon (29th) the water heater ruotured and our inspector was summoned to review the problem. In the opinion of the inspector the rupture was brought about by the water service problem and ordered a new heater installed. 3. ALTERNATIVE: a. Pay the bill and charge it to good public relations. b. Don't pay hill on basis that heater was due for replacement 4. TION: Pay the bill (152.03). commendation Approved: G. A. PROBLEM: We have concluded an agree ent, subject to Board approval, with Mr. and Mrs. Cheadle in the amount of $147.50 for an easement in D.S.P. 1957. 2. : Refer to Board memorandum dated August 4, 1971, regarding authorization for the filing of condemnation proceedings against Parcels 1 and 5 of the above mentioned D.S.P. 1957. 4. PROBLEM: Three of the five easements required have been secured, however, -------- Mx. Shirley (10 Rahn Court, Walnut Creak, Parcel 1) and Mr. Casamayor (42 Mayo Lane, Walnut Creek, Parcel 5) were approached numerous tines and after consider- able negotiation refuse to grant us the required easements for any reasonable consideration. 2. BA ROUND: Refer to Memorandum dated March 22, 1971, and March 2, 1971, Which listed 5 projects needed to correct serious system deficiencies,in Which project No. 1957 was included and Which are attached hereto and made a part hereof. 3.ALTERNATIVE: Cancel project, pay claims that may arise from overflow of existing system. face Water Quality Control Board action and local complaints. Horstkotte, Jr., General Manager -Chief Engineer SUBJECT; Staff Report on Garbage Increase, Diablo Disposal Service, Inc. FACTS. a. Letter of Doris J. Redmon dated 1 June 1971, requesting rate increase with justification attached. Justification includes the following data: (1) Income Statement for the year. 1970. (2) Number of residential customers. (3) Schedule of requested rates. (4) List of Diablo Disposal Service personnel with dates of employment. (5) Customer/Service Rate/Revenue. Schedule for the years 1971-73. (6) Detailed Multi-Family/Service--Rate Revenue Schedule for the years 1971-73. (7) Detailed Commercial/Service -- Rate Revenue Schedule for the years 1971-73. (8) Projected Income Statements for the years 1971-73. b. Customer/Service--Rate Schedule, prepared by staff. c. Projected Income Statements, 1971-73, prepared by staff. d. Comparative Rate Schedule, prepared by staff. 2. GENERAL COMMENTS: a. Data developed in this report represents information derived from financial statements for 1970. Ideally, data spanning a period of five years is desirable. b. In its determination of costs, staff utilized comparisons of data from other franchisees. As a consequence, it was determined that Diablo Disposal has inadequate parking space available at its awn facilities and therefor rents space for seven vehicles at Valley Disposal. Cost of rent is $50,00 per month per vehicle or $4,200.00 annually. In addition, it was determined that equipmeat owned by Diablo Disposal is inadequate to collect and remove drop boxes, As a consequence, in 1970, Diablo paid Valley Disposal $,,)4.00 to service Diablo customers. c. Historically, management of Diablo Disposal has applied a variable rate schedule predicated on the distance customers are from the Acme Fill dump or from. Diablo Facilities. 3. RECOMMENDATIONS a. The Board of Directors consider granting a rate increase effective August 1, 1971 for, only the remainder of this year. Rate increases for all franchisees for the. year 1972 and 1973 to be determined at a later date. b. Mr. Paul Hun ter on July 12, 1971 addressed a letter to Mr.oriarty, Supervisor, Third District, Contra Costa County (copy to the District) expre ing his opinion that the rate increase granted Orinda/ Morna w excessive. Staff responded to Mr. Hunter's letter (copy to Mr. Moriarty)'. Board Members received a copy of all correspondence at the July 22 meeting. b. Mr. Hunter, upon receipt of staff correspondence has addressed a sec•. letter to the District (copy to Mr. Moriarty) expressing his views on the rate -increase. c. Mr. Thomas R. La Basco addressed a letter to the District on July 15 (copy to Governor Ronald Reagan and State Senator John A. Nejedly) expre sing 'hip views on the r--te Lucre M a granted Qrinda/Moraga. Staff responded to Mr, La Basco's letter stating that his letter would be presented to The Board of Directors and that a further reply would be forthcoming. 3. GE proposed Di a.
