(Handout) Mr. Burkhardt's materialAN ORDINANCE OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT REPEALING EYJSTING DISTRICT CODE CHAPTERS 6.20 REBATE FEES AND 9.12 REBATE SEWAGE FACILITIES, AMENDING SECTION 1.04.100 DEFINITIONS, AND WHEREAS, it is necss"rY to revise the District Code to provide a new process for establishing reimbursement fees which would require the District Board of Directors to adopt such reimbursement fees by ordinance after �*:' ' ; _ -" - hearing, and having provided additional specific notice to affected PrOP" Owners prior to the public heMng; and WHEREAS, now code Provisions are necessary to clarify the method fbr calculation of reimbursement fees and procedures for administering reimbursement accounts, provide for special facilities reimbursements, allow establishment of reimbursement accounts prior to construction Of special facilities, and establish reimbursement fee deposit accounts, determine reimbursement fee deposit amounts and collect such reimburwwt fee deposits from property owners who apply to connect their property to standard or special facilities prior to adoption of reimbursement fees fbr such facilities; and WHEREAS, tO accommodate the needed revis Rebate Fees and Chapter 9.12 Rebate Sewage Facilities shall be repealed and replaced with a new Chapter 6.20 Reimbursement Fees, and proper notice has been given of the availability of the text of the Proposed new chapter for public inspection and review at the Districra office; and WHEREAS, a properly noticed public hearing to receive comments on the proposed code revisions was conducted b�,L�fte meeting on March 19, 1998, at which time the public hearing was continued to their regularly scheduled meeting on May 7,1998; and WHEREAS, the continued ic hearing NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District does ordain as Mlows: Existing District Code Chapter 6.20 Rebate Few and Chapter 9.12 Rebate Sewage Facilities are hereby repealed, effective June 1, 199& A new Chapter 6.20 Reimbursement Fees, is hereby incorporated as set forth in full in Exhibit "A" to this Ordinance by Ajs Existing District Code Section 1.04.100.28 is amended to read: % Gerwal Martager-Chief Engineer means the chief executive Officer of the District or a duty wiftrized designee." � 5 - 1 'UrT, ""MWO"'MME and Wiall be published mm in the Conte Costa Times, a newspaper of general circulation, published and circulated within the Central Contra, Costa Sanitary District, and shall be effective June 1, 1998. She told me about the conversation, and I have looked into the situation with your account. The District cannot 'swap'the parcels owned by ivy in order to collect a reimbursement fee on your behalf. I know this the current owner owns it, and therefore, you will not collect a reimbursement from it. I'm sorry, but District Code clearly specifies that a parcel must make a physical connection to the mainline extension in order to collect a reimbursement fee, and the parcel at 2 Hilferd simply cannot make a physical connection to Job 2475 due to location and topography. i am sorri, inis is Me case aTM 11=03257= there isn't.
