RESOLUTION NO. 2017-
A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT
AUTHORIZING ENTERING INTO A CONTRACT FOR EMERGENCY REPAIRS AT
THE TREATMENT PLANT PRIMARY SEDIMENT TANKS PRIOR TO THE WET
WEATHER SEASON
WHEREAS, a capital improvements project, Mechanical and Concrete Renovations,
District Project No. 7351, was identified in the Comprehensive Wastewater Master Plan
and included in the Fiscal Year (FY) 2017-18 budget for design and construction to
occur during the FY 2018-19 and FY 2019-20 period;
WHEREAS, the Mechanical and Concrete Renovations, District Project No. 7351 was
intended in part to renovate the Primary Sedimentation Tanks (PST) due to the
mechanical equipment nearing the end of its useful life;
WHEREAS, in August of 2016 and January of 2017, the sludge collector systems in
PST No. 4 and PST No. 1, respectively, failed and required immediate interim repairs by
staff;
WHEREAS, in May of 2017, a second failure occurred to PST No. 1, which required
additional repairs to the flights and chains;
WHEREAS, due to the multiple recent PST mechanical failures, staff initiated condition
assessments on all four PSTs to determine the extent of replacement and repairs that
might be necessary prior to the upcoming wet weather season to ensure continued
operations during anticipated heavy flow periods;
WHEREAS, the necessary near-term repairs identified included, at a minimum, the
replacement of the embedded rails, flights and chains in order to ensure the PSTs
operate reliably during the wet weather season;
WHEREAS, portions of the mechanical equipment required for proper repairs (chains
and flights) are proprietary to the original manufacturer and the lead time for delivery of
these parts is six to eight weeks;
WHEREAS, section 3400(c) of the California Public Contract Code sets forth certain
conditions under which a product may be purchased to match existing equipment
without a competitive public procurement;
WHEREAS, the standard design -bid -build process, coupled with the lead time
necessary for the mechanical parts, does not allow sufficient time to perform the repairs
prior to the wet weather season; and
WHEREAS, failure of one or more PST collector systems during the high flows
experienced in wet weather conditions creates the potential of a failure to meet all
National Pollutant Discharge Elimination System (NPDES) permit conditions;

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Central Contra
Costa Sanitary District (Board) as follows:
THAT, substantial evidence exists of an emergency need for the replacement and repair
of the embedded rails, flights, chains within the PSTs and such repairs must be
completed prior to the 2017-18 wet weather season to reasonably ensure proper
operation;
THAT, insufficient time is available to undertake these necessary repairs through the
normal design -bid -build procurement process;
THAT the Board finds that the public interest is best served by a sole -source
procurement of the flights and chains;
THAT the Board independently finds that this project is exempt from the California
Environmental Quality Act (CEQA) under Central San CEQA Guidelines Section 15302
since it involves the replacement of existing public facilities at the same location and
with the same purpose; and
THAT, the General Manager is authorized to enter into a contract under a change order
with W. M. Lyles to be funded out of the Mechanical and Concrete Renovations, District
Project No. 7351.
