Bailey Kenton L.Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to accept grants of easement, execute quitclaim deeds and record those documents with the Contra Costa County Recorder. August 3, 2017 Regular Board Meeting Agenda Packet- Page 33 of 132 Page 2 of 4 BACKGROUND The subject easement is needed to accommodate a sewer segment realignment included in the Lafayette Sewer Renovation, Phase 11, District Project 8430. Owner Address APN Price Rob Clark 1060 Via Roble, Lafayette 244-051-007 Exchange Once Central San accepts the new easement from Rob Clark, the sewer pipe will be relocated within the new easement. I n exchange for the new easement, Central San will quitclaim its original easement. Staff has concluded that this action is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15305, since it involves a minor alteration in land use limitations.Approval of this project will establish the Board of Directors' independent finding that this action is exempt from CEQA. ALT ERNATIVES/CONSIDERATIONS None. FINANCIAL IM PACTS None. COMMITTEE RECOMMENDATION This item has not been reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt resolutions (1)accepting a grant of easement from Rob Clark; (2) authorizing the execution of a quitclaim deed to Rob Clark, and (3)authorizing staff to record the Grant of Easement and Quitclaim Deed with the Contra Costa County Recorder. Proposed Resolution Quitclaim August 3, 2017 Regular Board Meeting Agenda Packet- Page 34 of 132 Page 3 of 4 RESOLUTION NO. 2017- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A GRANT OF EASEMENT RELATED TO THE LAFAYETTE SEWER RENOVATION PROJECT, PHASE 11 DISTRICT PROJECT 8430 BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT the District hereby accepts a Grant of Easement dated July 17th, 2017, from the following property owners: Rob Clark, a married man as his sole and separate property 1060 Via Roble, Lafayette (APN: 244-051-007) THAT staff is authorized to record the document in the office of the Recorder of Contra Costa County. A RESOLUTION AUTHORIZING EXECUTION AND RECORDING OF A QUITCLAIM DEED-EASEMENT TO ROB CLARK 1060 VIA ROBLE, LAFAYETTE, LAFAYETTE SEWER RENOVATION PROJECT, PHASE 11, DISTRICT PROJECT 8430 BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby consents to the execution of a "QUITCLAIM DEED- EASEMENT" to Rob Clark, a married man as his sole and separate property, Lafayette Sewer Renovation Project, Phase 11 — Parcel A, dated August 3, 2017; THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said document for and on behalf of Central San; and THAT staff is authorized to record said document in the office of the Recorder of Contra Costa County.
