Bailey General Manager ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and provides that an Order of the Board of Directors of the District to the effect that the ordinance has been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND Summaries of District Ordinance Nos. 294 and 295, which were adopted by the Board at its meeting on April 20, 2017, were published in the Contra Costa Times and San Ramon Dalley Times on June 2, 2017. Summaries of District Ordinance Nos. 296 and 297, which were adopted by the Board at its meeting on June 1, 2017, were published in the Contra Costa Times and San Ramon Dalley Times on June 23, 2017. ALTERNATIVES/CONSIDERATIONS Establishes presumption that the ordinance was correctly published and therefore would be deemed procedurally valid by a court.
