ISSUE
Mr. Charles Burkhardt has requested payment of certain reimbursement fees. Staff believes that since no
fees were collected for the parcel in question, under District Code they are not able to pay him those
fees.
District Code section 1.16.010 allows that any person may appeal a final staff decision to the Board of
Directors.
BACKGROUND
When a public sewer main that might reasonably serve other parcels is installed by a private party, District
Code allows that person to apply for a reimbursement account. When other parcels are connected to the
project sewer, Central San collects a reimbursement fee and forwards it to the installer. This matter
concerns a reimbursement account that was set up in 1980 and is complicated by changes in District
Code overtime.
History
In 1979, Mr. Charles Burkhardt constructed approximately 540 linear feet of sewer line on Montair Drive in
Danville to serve his property. The project was eligible for Central San's reimbursement program. Mr.
Burkhardt submitted a letter with the required information and the reimbursement account was created.
The creation of the reimbursement account was confirmed to Mr. Burkhardt in a letter on July 9, 1980.

The letter described 2 parcels with 1 connection each and 2 additional upstream parcels with 1/4
connection each. The letter stated
Parcels assigned a %rebate unit would only be assessed a $1,001 rebate fee ($4,005 4) since
these parcels install additional public sewer main prior to connection.
n 1998, Central San revised the District Code. Changes to the reimbursement program included specific
language for"standard facilities" and "special facilities". I n order for a parcel to be subject to a"standard
facility' reimbursement fee, it must be connected directly to the sewer main installed by that job. "Special
facility' criteria include tunneling and other high-cost construction situations. Under the revised code,
reimbursement fees are collected from parcels connected directly and indirectly to a special facility.
In 2002, one of the "1/4 connection" parcels was connected to the upstream sewer. Central San collected
a reimbursement fee of approximately$1,300 and forwarded it to Mr. Burkhardt. The reimbursement fee
amount represents the original $1,001 fee inflated by the Engineering News Record index and
depreciated as prescribed by District Code.
The remaining "1/4 connection" parcel is located at 2 Hilferd Way(APN 199-120-003). 1 n 2010, a note
was made on this parcel in Central San's SunGard and G IS systems which stated:
Deleted from parcel count for[reimbursement]2475. Do not collect[reimbursement]for Job
2475
The Connection of 2 Hilferd Way
n May, 2015, the property owner of 2 Hilferd Way obtained a permit from Central San to connect the
parcel to the public sewer. No reimbursement fees were collected. The final inspection on the permit was
signed off on April 29, 2016.
Beginning in 2015, Mr. Burkhardt contacted Central San several times about a reimbursement fee for the
parcel at 2 Hilferd Way. Mr. Burkhardt's request was escalated and the entire history of the reimbursement
account was reviewed. On May 18, 2017, Mr. Burkhardt was advised that since no reimbursement fee
was collected from the owner of 2 Hilferd Way, staff was unable to provide a reimbursement fee to him.
ALT ERNATIVES/CONSIDERATIONS
The Board of Directors could find that Mr. Burkhardt is entitled to the reimbursement fee and direct staff to
issue payment from the Sewer Construction Fund. Staff has calculated that the current value of the
reimbursement fee for 2 Hilferd Way would be $1,616.
Alternatively, the Board of Directors could find that Mr. Burkhardt is not entitled to a reimbursement fee.
FINANCIAL IM PACTS
If the Board of Directors finds that Mr. Burkhardt is entitled to a reimbursement fee, this would result in an
expense of$1,616 which would be taken from the Sewer Construction Fund.
COMMITTEE RECOMMENDATION
This matter was presented to the Finance Committee at their July 25, 2017, meeting.
