A resolution of the B oard of D irectors passed by f our af f irmative votes is needed to place charges on the C ontra C osta C ounty property tax roll f or collection. T he F iscal Year 2017-18, S S C rates were adopted on A pril 20, 2017 and are ef f ective J uly 1, 2017. T he rate f or single f amily homes is $530 per parcel. S S C rates f or other property types can be f ound in O rdinance 294. C ontra C osta C ounty imposed a f ee f or collecting the S S C on the tax roll starting in F iscal Year 1982-83. C ertain commerc ial tenants and commercial property owners have entered into written agreements to participate in C entral S an’s C apacity Use P rogram f or payment of C apac ity F ees over a 15-year period. T hese busines s es are listed in E xhibit A . P roperty owners who have f ormed C A D s have agreed to pay f or sewer improvements over a 10-year period. T hes e properties are listed in E xhibit B . P roperty owners who have f ormed AVA D s have agreed to pay f or sewer improvements over a 15-year period. T hes e properties are listed in E xhibit C . C ertain property owners have entered into written agreements to participate in C entral S an’s f ee installment payment programs. T hese properties are listed in E xhibit D . P ayments are to be collected by placing as s essments and charges on eac h property owner ’s tax bill. L egal notices were published in the Contra Costa Ti mes and the San Ramon Val l ey Ti mes f or the public hearing. Notice of the public hearing was also posted on C entral S an’s website. ALT E RNAT I V E S /C O NS I D E RAT I O NS D irect collection of these charges by C entral S an staf f is an alternative. However, it is economical and ef f icient to collec t the charges on the property tax bills. O wners of the properties subject to C apacity Us e C harges, C A D and AVA D assessments, and charges f or installment payment programs have signed agreements that the charges will be placed on the property tax roll. F I NANC I AL I M PAC T S T he estimated C ounty-imposed f ee f or collec tion of the charges on the tax roll is $110,000. C O M M I T T E E RE C O M M E ND AT I O N T his matter was not reviewed by a B oard c ommittee. Tax R oll R es olution and E xhibits A -D July 20, 2017 Regular Board Meeting Agenda Packet - Page 35 of 151 ITEM 7 Page 3 of 10 RESOLUTION NO. 2017-____ A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT DIRECTING THAT THE FISCAL YEAR 2017-18 SEWER SERVICE CHARGES, CAPACITY USE CHARGE PROGRAM CHARGES, ASSESSMENTS FOR CONTRACTUAL ASSESSMENT DISTRICTS, ASSESSMENTS FOR ALHAMBRA VALLEY ASSESSMENT DISTRICTS AND CHARGES FOR OTHER FEE INSTALLMENT PAYMENT PROGRAMS BE COLLECTED ON THE CONTRA COSTA COUNTY PROPERTY TAX ROLL WHEREAS, the Central Contra Costa San itary District (District) has previously developed and instituted a Sewer Service Charge Program for services and facilities furnished by the District to finance yearly Operation and Maintenance of the District; and WHEREAS, the sewer service charge is collected through a direct charge to the users; and WHEREAS, the District has entered into written agreements with certain commercial tenants and commercial property owners to participate in the District’s Capacity Use Charge Program for payment of capacity fees in annual installments over a 15-year period; and WHEREAS, the District has entered into written agreements with certain property owners who have formed Contractual Assessment Districts to pay for sewer improvements in annual installments over a 10-year period; and WHEREAS, the District has entered into written agreements with certain property owners who have formed Alhambra Valley Assessment Districts to pay for sewer improvements over a 15-year period; and WHEREAS, the District has entered into written agreements with certain property owners for payment of capacity fees and other certain charges over various periods; and WHEREAS, District Code provides that the District may elect to collect current charges on the property tax roll as provided by Section 5470 and following, of the California Health and Safety Code; and WHEREAS, it is considered economical and efficient to collect all of the above- described fees and charges for Fiscal Year 2017-18 on the Contra Costa County property tax roll.
