Authorize President and Secretary to execute consent agreement with Po G. & E. covering right of way through E. B.M. U. D. property near Orinda Crossroads where P. GO & Eo has power line right of .;*ay. 6 Adopt specification changes interpretations for Sewage Treatment Plant specifications (Mr. Kennedy will explain) { Consider change in contract for Section ZI to relocate siphon crossing of Tice Creek at Newell Avenue to north side of Tice Creek bridge, The location as shown in the contract plans is only 3 feet off of the Soherman property and it appears impossible to construct the work without a temporary encroachment on the Schernian property. Mr, Scherman has indicated unwillingness for granting such temporary working space and the possibilities of damage to his property exist, In addition, the existing water and gas lines give an impaired working space on the south side of Newell. Avenue. The contractor has agreed to install this work at no change in price under his contract, The relocation will involve moving one joint power and telephone pole at an estimated cost of not to exceed. 375OO which the District would have to pay. It is recommended that this change be approved as outlined. 8. Decide whether bonds shall be printed with coupons which became due on December 150 1947 or whether these coupons shall be cancelled. If the bonds are delivered with the coupons uncancelled the purchaser will have to pay accrzed interest and collect this interest back by clipping the coupons and presenting them to the County Treasurer for payment. If these coupons are cancelled befors the bonds are delivered it 1d.11 reduce the amount of accrued interest in proportion; these amounts cancel each other and. the District has nothing to gain or lose by having the bonds printed either way. The County Treasurer advises that Carlisle & Company must be informed as to what our desires are in regard to these coupons dated December 15, 1947, also that the bonds may be printed with these coupons cancelled or valid at our choice. The County Treasurer further requests that we furnish him with bond folders as well as bond register. These may be secured from Carlisle & Mr. Craig, attorney for Dr. Maloney advises by phone that Dr. Maloney is not willing to agree to the offer of the District for easement through his property. Mr. Craig suggests that the District 14 co. reconsider the amount offered, namely 05O, and also consider the possibility of granting Dr. Maloney the right to connect his house sewer to the main trunk sewer at the manhole which will be within Y property, y� theMaloneyert and further that the Board. grant Dr. Maloneyt s � request for specific statements as to how the work would be pelf ormed within his property and incorporate such statements into an agreement with Maloney, The specific statements which Maloney requests are covered by the specifications for the work and the deed of dedication for easement which was presented to him, with the exception of the statement which he requested that the District would be liable for any damage to his house due to settlement from tunnel operations, It appears that these stipulations could, be covered in a separate agreemet with Maloney in some form which would be satisfactory to him. It appears to Mason that the Doctor will force a condemnation action and court trial unless we do concede to his request on the matter of a separate agreement between him and the District®
