2. Appoint Secretary Pro Tem.
3. Reading of Minutes of previous meeting.
4. Hearing of Pacheco Petition. Petition of property owners in the
Pacheco -Highway Junotion area was published in the Courier -Journal
on December 22 anti 29. Affidavits of publication are on hand. The
Board should now maks a determination as to:
a. Whether or not it is for the beet interest of the District and
the proposed annexation that the territory be annexed.
b. Modify the boundaries of the proposed annexation or accept it
in the described boundaries. Resolution has been prepared and
is at hand covering this matter.
Consider minimum wage -scale. The District has been advised that an
assistant solicitor for the Department of Labor has stated that the
minimum rate for common labor in Contra Costa County of 41.50 will
be recognized from December 24, 1947 for Federal work. By letter
dated January 5, the attorneys for Laborers' Union Local 324 request
the Board to make a redetermination of the prevailing rate for
laborers for work to be performed for the Sanitary Dietriot. The
engineer expecte to have plans and speeinoations for additional
construction reedy for adoption on January 22, and the matter of
adopting a *age scale for those contracts will some up at that time.
It is considered that the Board can make an informal expression of
its intentions this evening but that formal action to amend the image
scale could not be taken at this meeting.
6, Consider taking action of sale of the balance of $6oO,OOO in general
obligation bonds authorized at the election of June 3. The market
for bonds has declined considerably since the first 41,800,004 of
the District's bonds were sold at an average Interest rate of 2.8
It is believed that the market will continue to decline and that the
Board should order the sale of the balance of the bonds immediately,
for the following reasons:
a. It is probable that interest rates will continue to increase.
b. The proceeds from the sale of these bonds will be required to
meet commitments for csonatruotion before the end of 1948.
o. There is usually a seasonal trend with better interest rates
offered for bonds during the first three months of a calendar
year than during the balance of the year due to reinvestments
by the firms that usually purchase such bonds.
The County Auditor advised by letter on December 30 that in his
opinion the District could now sell the full balance of $600,000
authorized, but verbally advised Messrs. Smitten and Cutler on January
7 that Mr. George Herrington had advised him that this could not be

done and that 4500,000 only could be sold now. The reason for this
conflict of opinion is die 'Co the fact that the current equalized
assessment roll of the Sanitary District is in the mount of

19, and does not include the terrlboriee annexed during 1947, which
territories were annexed prior to the bond election and are therefore
security for the bonds, and those territories have an assessed qalus»
tion in excess of $2,000.000,
Section 66,y1 of the Health and Safety Code states that the outstanding
bonds of the District may not sassed "15% of the assessed valuation of
the real and personal,ropert�r in the District". The matter of validity
of ale of the entire �600,000 is then as to whether the current
aaeesement roll of the District must be taken as the basis for figuring
or whether the actual assessed value of the District (including the
annexed territories must be taken as the bae3.$).
On January 7 Mr. Herrington advise Mr. peon that his Opinion had been
given without taking into consideration the values in the annexed
territories and that he was reconsidering his opinion and would
furnish further advice.
TO SUMMARIZE: There is no question that the District can sell 000,000
additional bonds, and it appease that the full unsold
balance may be gold. It is suggested that the Attorney
be instructed to prepare the necessary' resolutlonQ to
effect this bond ease.
7. Well at treatment plant site. It is recommended thatite Board authorize
the District Engineer to esus the spec3fiastion and gall for bid,
without Formal advertising for a contract for drilling a water well at
the sewage treatment plant site. Inaemuoh as the drilling of a well
to get the required quantity of water involves any uncertainties and
it has been found to be impracticable to include this item in the plans
and specifications for the sewage treatment plant on which a lump sum
bid is proposed. It is desired to invite proposals from all loaa3.
well drillers for bide on drilling and testing the water well on the
plant site, which well will be an integral part of the sewage treatment
plant. This covers the drilling and testing of the well only, and the
balance ot equipment such as pump and pipe are included in the treatment
plant plane.
