B. Near property in consideration of grant of easement for Main Trunk Sewer for Section VI. The route of main trunk sewer Section VI passes through the Near property and will produce some damage to existing trees. Mr. and Mrs, Near have signed a Deed of Dedication of the desired sewer easement, 860 feet in length and have delivered this Deed on the verbal assurance of Mr. Mason that the Board would not accept the Deed unless theconsideration recommended above were granted. This action was taken in the ease of the Wm. Freeman property and the circumstances in the Near property are exactly comparable in that the Near property will not logically become a part of any Local Improvement x District. It is recommended that the Board authorize Mr. J. B. Near to connect the homes on bis home property to manholes on the Main Trunk Sewer of Section VI without further charge for such connection, in consideration of grant of easement to the District for Paroei 12 of Section VI Main Trunk Sewer, and with no further payment to Mr. Near for this e R sement . 12. Mr. Jack DeMartini, the lesee of lands from Hooper and Company adjoining and surrounding the lands leased by the District, has requested that the barbed wire for the fencing around the Oxidation Ponds be so placed that an additional strand of wire may be added to the f enci nr . The specifications call for posts e#itending approximately 5 feet above ground with 3 strands of barbed wire. Mr-, DeMartini says that his cattle would go through or over such a fence and that 4 strands of barbed wire are necessary to keep the cattle from getting into our Oxidation Pond area, Mr. Dear ini has suggested " that the District furnish the additional barbed wire necessary to place the 4th strant anc5 that he would provide the labor for the work. We have instructed the contractor to space the wire so that a 4th etrand might be added and Mr. Mason has suggested to Mr. DeRartini that he add the 4th strant of wire at his own expense. The cost of the necessary wire le approximately *90.00. Mr. DeMartini was per- mitted to pasture this land and later to out hay on the 106 acres leased by the District. This was done as a counter consideration to the fact that Mr, DeMartini was interfered with by our operations in the use of the grazing lands adjoining during the construction. It is felt that the favors extended to Mr, DeMartini fly compensate him for any inconvenience wbioh he has experienced and that we would have balanced the books in this matter if we permit him to add a strand of, wire to our fent at his own expense. It is suggested that the Board instruct the Dis,rict Manager to advise Mr. De art lni that he may place this extra strand of wire on our fence at his own expense. 13.
