Leiber--Director of Finance and Administration ISSUE: District Code and State law require that a public hearing be held to receive public comment on placing the Sewer Service Charges, Capacity Use Charges, assessments for Contractual Assessment Districts and Alhambra Valley Assessment Districts, and other fee installment payment programs on the County property tax roll for collection. BACKGROUND: California Health and Safety Code section 5473.1 and District Code section 6.24.150 require the holding of a public hearing to consider the report identifying properties and their associated charges that will be transmitted to the Contra costa County Tax Collector for collection on the property tax roil. At the public hearing, the Board will hear any objections or protests to the report. If a majority of property owners object to collection on the tax roll, then the charges must be billed directly. At the conclusion of the hearing, the Board may adopt, revise, change, reduce or modify and charge or overrule any or all objections to the report. Legal notices will be published in the Camra Costa Times and the San Ramon Valley Times and the Notice of Public Hearing will be posted on Central San's web site. Certain commercial tenants and commercial property owners may elect to participate in Central San's Capacity Use Charge program for payment of Capacity Use charges over a 15-year period in lieu of capacity fees. Participants agree to have the annual Capacity Use Charge placed on their property tax bill. Property owners who have formed Contractual Assessment Districts (CADS) have agreed to pay for sewer improvements over a 1 0-year period. Payments are to be collected by placing assessments on each property owner's annual property tax bill. Property owners who are converting their properties from septic tank to sanitary sewer, and AVAD non-participants who are connecting their properties may elect to participate in Central San's fee installment payment programs. ALTERNATIVES/CONSIDERATIONS: The Board may decline to establish the recommended public hearing date or may elect to choose a different date. However, a public hearing must be held if assessments and charges are to be placed on the County tax roll for collection. FINANCIAL IMPACTS: None by this action, however, the staff recommendation to place assessments and charges on the County tax roll is the most efficient and cost- effective method of collection. The alternative, direct billing of these charges, would incur additional staff time and could result in a lower rate of collection. RECOMMENDED BOARD ACTION: Set a public hearing for July 20, 2017 to receive comments on placing Fiscal Year 2017-18 Sewer Service Charges, Capacity Use Charges, assessments for CADS and AVADs, and other fee installment payment programs on the Contra Costa County tax roll for collection.
