H. JAY KERR On November 20, 2014, Dr. H. Jay Kerr requested that the Board consider providing relief from staff's final decision that a $2,158.20 capacity fee was owed for a 1,680- square foot building constructed adjacent to an existing 30,310 square foot commercial building; a 6% increase in size. Dr. Kerr contended that no additional wastewater would be generated from his new building. The Board requested staff monitor water consumption data after completion of the building and compare to the 2014 baseline. Construction was completed on the new building in April 2015. That same month, the governor issued an executive order requiring a statewide 25% reduction in potable water use due to the drought. Staff has reviewed annual water consumption data for 2012 through 2016 for Dr. Kerr's parcel. The parcel is served by two water meters, one of which shows large seasonal variations in flow so consumption from that meter is adjusted based on Winter Quarter consumption when calculating the annual sewer service charge. Annual water consumption, including the Winter Quarter adjustment, is shown in the table below. Staff believes that the 32% decrease in water consumption from 2014 to 2015 is most likely due to changes related to water conservation from the drought and that this value would likely be the best representation of baseline water use. From 2015 to 2016, water consumption increased 12%.
