Petit—Director of Engineering &Technical ServicesKenton L.Alm Roger S.Bailey Counsel for the District neral Manager ISSUE: A resolution of the Board of Directors is required to accept offers of dedication for sanitary sewer easements (SSE) that convey or.alter any real estate interest to Central San and to record the document in the office of Contra Costa County Recorder. BACKGROUND: Located in the Gale Ranch, Phase 4, Road Acceptance 1250, Subdivision 9341, of San Ramon, Shapell Industries (Original Developer) initiated the planning and entitlement phase for this new subdivision. Subsequent to Central San's acceptance of the public sewer constructed with Job 6528, the Original Developer sold their interest to Toll Brothers (New Developer). AND TOLL BROTHERS (ROW PARCELS 2, 4 AND 4A) AS RELATED TO GALE RANCH PHASE 4, ROAD ACCEPTANCE 1250, JOB 5528, SUBDIVISION MAP 9341, LOCATED IN SAN RAMON Upon completion of the sewer work, the New Developer desired to change the SSE limits located in Lot 37 (526 M 46) as the original easement overlaps the footprint of the planned residential home. The proposed modification to the SSE limits will not reduce or diminish Central San's access to the public sewer as the new SSE limits comply with Central San's right of way requirements for new public sewers. The Board of Directors historically accepts easements by resolution. This position paper recommends adoption of a resolution to accept offers of dedication for sanitary sewer easements for new public sewers. Strategic Plan: Adoption of this Resolution will further advance Central San's Goal 5, Maintain a reliable wastewater infrastructure; in addition, defined easements are necessary to effectively and efficiently maintain and operate public sewers on private property. These easements meet the requirements as outlined in Title 7, Real Property and Improvements, of District Code and Section 8, Property Rights of Wastewater Facilities, of the latest Standard Specifications for Design and construction of Sewers. ALTERNATIVESICONSIDERATIONS: None. FINANCIAL IMPACTS: The offers of dedications for sanitary sewer easements were acquired at no cost to Central San. COMMITTEE RECOMMENDATION: This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION: Adopt Resolution to: (1) Accept offer of Dedication for Sanitary Sewer Easements from Shapell Industries and Toll Brothers as shown on Final Map for Subdivision 9341 (525 M 46) (Parcel 2); (2) Accept offer of Dedication for Sanitary Sewer Easements from recorded Irrevocable offer of Dedication (2015-0255302) in its entirety (Parcel 4), except to exclude a portion of the Sanitary Sewer Easement lying within Lot 37 (526 M 46) (Parcel 4A); and (3) Authorize staff to record said documents with the Contra Costa County Recorder. Proposed Resolution Page 2 of 2 ATTACHMENT I RESOLUTION NO. 2017-0/1 A RESOLUTION TO ACCEPT OFFERS OF DEDICATION FOR SANITARY SEWER EASEMENTS FROM SHAPELL INDUSTRIES, INC, AND TOLL BROTHERS (ROW PARCELS 2, 4 AND 4A), AS RELATED TO GALE RANCH PHASE 4, ROAD ACCEPTANCE 1250, JOB 6528, SUBDIVISION MAP 9341, LOCATED IN SAN RAMON WHEREAS, as part of Sewer Job 6528, Shapell Industries, Inc., a Delaware corporation, (Original Developer) offered to Central Contra Costa Sanitary District (Central San) sanitary sewer easements (SSE) on the f=inal Map titled "Subdivision 9341, Gale Ranch" and said map was filed on October 14, 2015, in Book 526, page 46 of Maps (526 M 46) as Document No. 15-212481 at the office of Contra costa county Recorder; and WHEREAS, the Orig-final Developer for the same sewer job also offered SSEs to Central San with the recordation of a Grant of Irrevocable Offer of Dedication (IOD) and said deed was recorded on June 5, 2015, as Document No. 2015-0114714 at said county recorder's office; and WHEREAS, the original Developer sold the project to Toll Brothers (New Developer) and upon completion of the sewer work the New Developer desired to change the limits of the SSE for Lot 37 of 526 M 46 as the original easement overlaps the footprint of the planned residential home. The proposed modification to the SSE limits will not reduce or diminish Central San's access to the public sewer as the new SSE limits comply with Central San's right of way requirements for new public sewers. BE IT RESOLVED by the Board of Directors of central San as follows: THAT Central San hereby does accept the offered SSEs on said Final Map (ROW Parcel 2) (APN 222-760-059); and THAT central San hereby does accept the offered SSEs on said IOD (ROW Parcel 4) (APNs: 222--770-025 through 222-270-028, and 222-270-050) in its entirety except the SSE limits of Lot 37 shall be modified and the area to be exclude from acceptance by Central San is shown as attached plat and legal description (Parcel 4A) (APN 222-770-025); and THAT staff is authorized to record this resolution in the office of the Recorder of Contra Costa county.
