ISSUE: Board of Directors' approval is required for any salary adjustment that exceeds
the adjustment in the statewide Consumer Price Index (CPI) for any employees that are
not represented by a union or recognized employee organization and considered a local
agency executive.
BACKGROUND: One of the provisions of the Memorandum of Understanding (MOU)
between the District and the Management Group is that employees represented by the
Management Group will receive a yearly CPI adjustment with an additional one percent
(1%) wage increase above the CPI. Effective April 18, 2017, this increase is equivalent
to 4.4%, based upon the CPI of 3.4% for all Urban Consumers in the San Francisco 1
Oakland 1 San Jose region and the additional one percent (1%) wage increase.
As of April 18, 2017, per the MOUs,- all District employees, including Ms. Boehme, will
be contributing 100% of their employee share towards the pension.
The employment contract between the District and Ms. Boehme reflects that she will be
entitled to the same benefits as those afforded to the Management Group; hence, she is
entitled to a salary adjustment of 4.4% effective April 18, 2017.
However, pursuant to Government Code 3511.2, effective on or after January 1, 2012,
any salary adjustment for those employees considered a local agency executive that
exceeds the statewide CPI in any given year must be brought to the Board for approval
during a regular Board meeting.
ALTERNATIVES/CONSIDERATIONS: Deny the salary adjustment for Ms. Boehme;
however, this is not recommended as it would violate the terms of her employment
contract.
FINANCIAL IMPACTS: Upon approval, this action results in an annual cost of
$6,653.78.

RECOMMENDED BOARD ACTION: Approve the salary adjustment in excess of the
CPI for Elaine Boehme, Secretary of the District, in accordance with her employment
contract.
