ISSUE: A resolution of the Board of Directors is required to execute a real property
agreement and to record the document.
BACKGROUND: The Lafayette Tennis Club brought improvement plans to Central
San and requested approval for replacing a viewing deck in the parking lot. Staff
informed the owners that there was a Central San sanitary sewer easement in the
parking lot and that existing improvements had not been approved. Staff determined
that the deck replacement was being done in conjunction with a retaining wall
replacement that would safeguard the parking lot and Central San's sanitary sewer
main. Staff requested that the owner enter into a real property agreement to abate the
encroachment.
Board action is required to enter into the real property agreement.
ALTERNATIVES/CONSIDERATIONS: None.
FINANCIAL IMPACTS: None.
COMMITTEE RECOMMENDATION: This matter was not reviewed by a Board
Committee.
RECOMMENDED BOARD ACTION: Adopt a resolution authorizing the execution of a
real property agreement with Lafayette Tennis Club to abate encroachment upon a
sanitary sewer easement, and authorizing staff to record the documents with the Contra
Costa County Recorder.

EXECUTING AND RECORDING A REAL PROPERTY AGREEMENT AT
3125 CAMI NO D IABLO ROAD IN LAFAYETTE
(APN: 177-090-025)
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District
(Central San) as follows:
THAT Central San hereby authorized to execute a Real Property Agreement with the
following property owners related to the property located at 3125 Camino Diablo Road,
Lafayette:
Assessor's Parcel No.: 177-090-025
Property owners: LAFAYETTE TENNIS CLUB LLC
Site Address: 3125 Camino Diablo Road, Lafayette
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said documents for and on behalf of Central San; and
THAT staff is authorized to record this resolution in the office of the Recorder of contra Costa
County.
