Central San BOARD OF DIRECTORS POSITION P Board Meeting Date: March 2, 2017 Subject: ADOPT A RESOLUTION PROCLAIMING A LOCAL EMERGENCY ARISING FROM THE 2017 WINTER STORMS, RATIFY THE GENERAL MANAGER'S ACTIONS WITH REGARD TO THE MINER ROAD SINKHOLE IN ORINDA, AND AUTHORIZE THE GENERAL MANAGER TO CONTINUE EMERGENCY EXPENDITURES FOR THE MINER ROAD SINKHOLE Submitted By: Initiating Dept/Div.: Ann Sasaki Operations Department Deputy General Manager REVIEWED AND RECOMMENDED FOR BOARD ACTION.- Ann CTION.Ann Sasaki, Deputy General Manager 4 Kenton L.Alm Roger S.Bailey` Counsel for the Distric General Manager ISSUE: Consider adopting a resolution proclaiming a local emergency arising from the Winter Storms of 2017, ratify the General Manager's actions to date regarding the Miner Road sinkhole in Orinda, and authorize the General Manager to continue emergency expenditures related to the Miner Road sinkhole. BACKGROUND: On January 11, after days of heavy rain, a large sinkhole enveloped two Central San sanitary sewers that run along Miner Road in Orinda. As a result, these sewer lines, a 15-inch sewer and an 18-inch sewer, ruptured and heavily diluted sewage was discharged into Laute rwasse r Creek which flows into the San Pablo Reservoir, a drinking water reservoir. The City of Orinda owns a 72-inch storm drain that is located at the bottom of the sinkhole. Since January 11, Central San has been continuously bypass pumping around the site. Central San has and will continue to incur expenses in response to this incident. These expenses include outside services for bypass pumping, and increased direct labor costs including overtime for Central San Collection System Operations staff. The City of Orinda has entered into an emergency contract for repair of the culvert, roadway and replacement of Central San's sewer lines. This repair project has been delayed by continuing rains, which has resulted in ongoing emergency expenditures. Once repairs begin, the City anticipates the project will take approximately six to eight weeks. Therefore, repairs to Central San's sewer lines may not be fully completed until May or dune depending on weather and other factors. Staff estimates that approximately $120,000 of additional expenses have been incurred through February 21, 2017 for direct labor and overtime, pump rentals, and contractual services. Page 1 of 2 POSITION PAPER Board Meeting Date: March 2, 2017 Subject: ADOPT A RESOLUTION PROCLAIMING A LOCAL EMERGENCY ARISING FROM THE 2017 WINTER STORMS, RATIFY THE GENERAL MANAGER'S ACTIONS WITH REGARD TO THE MINER ROAD SINKHOLE IN CRINDA, AND AUTHORIZE THE GENERAL MANAGER TO CONTINUE EMERGENCY EXPENDITURES FOR THE MINER ROAD SINKHOLE Staff also estimates that approximately $70,000 in additional costs, including bypass pumping, will be incurred each month until the sewer repair work is completed. Sewer pipe repair costs are expected to be at least $25,000 and potentially substantially more. The State, county and city of Crinda have all proclaimed a state of emergency. Central San can also proclaim a local emergency by adopting the attached proposed resolution, which may aid in pursuit of potential reimbursement from state and federal sources. ALTERNATIVESICONSIDERATIONS: Do not proclaim an emergency. Provide alternative direction on continuing expenditures. FINANCIAL IMPACTS: This Miner Road sinkhole has cost central San more than $120,000 to date and total expenditures are estimated to range from a minimum of $200,000 to an estimated maximum of $500,000. COMMITTEE RECOMMENDATION: This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION: 1. Adopt the attached proposed resolution proclaiming a local emergency arising from the 2017 Winter Storms; and 2. Ratify the General Manager's actions related to expenditures to date for emergency protective measures at Miner Road; and 3. Authorize the General Manager to continue to expend central San funds for emergency protective measures and repairs in response to the storm damage on Miner Road. Attached SyoodLng Document: 1. Proposed resolution Page 2 of 2 ATTACHMENT I RESOLUTION No. 2017- A RESOLUTION of THE CENTRAL CONTRA COSTA SANITARY DISTRICT PROCLAIMING A LOCAL EMERGENCY ARISING FROM THE 2017 WINTER STORMS WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within the Central Contra Costa Sanitary District (Central San), caused by the 2017 Winter Storms; and WHEREAS, these conditions are, or are likely to be, beyond the control of the services, personnel, equipment and facilities of Central San; and WHEREAS, Central San is being required to expend funds for emergency protective actions due to these storms, including, but not limited to, emergency expenditures to address the Miner Road sinkhole matter in orinda; and WHEREAS, the General Manager has requested that the Board of Directors proclaim that a local emergency exists. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Central San: THAT the General Manager's request for a proclamation of a local emergency in accordance with the California Emergency Services Act and California Disaster Assistance Act, is hereby approved.
