BAILEY, GENERAL MANAGER Mir.- ANN SASAKI DEPUTY GENERAL MANAGER FROM: TEJI O'MALLEY, HUMAN RESOURCES MANAGER SUBJECT: UNEMPLOYMENT BENEFITS PAYMENT DATA V This memo is to provide an overview of unemployment benefits as well as annual costs related to all unemployment claims and what the District has done to mitigate these costs. OVERVIEW When an employee is separated from District service and applies for unemployment benefits, the District receives notification from the Employment Development Department (EDD) that an unemployment insurance claim has been filed. This notice provides general information about the claim, including the reason the claimant states he/she is no longer working. The District must respond to this notice and provide information, such as the employee's job title, salary, length of employment, last day of service, and reason for separation. The EDD utilizes this information to establish the employee's eligibility for unemployment benefits. After this information is provided, the District receives a letter of determination from the EDD regarding the claimant's eligibility for unemployment insurance (U I} benefits. This letter provides a reason for the decision, the applicable section code of the law, charges to the employer reserve account, and appeal rights. COST Over the past five fiscal years, the District has paid approximately $196,172 in unemployment benefits on 46 separate claims. In the same time frame, the District engaged 309 temporary employees (Summer Students, District Temps, Co-ops). Approximately 14.9% of those temporary employees have filed unemployment claims. SUMMARY Human Resources has and continues to provide information to the EDD that the claimants were hired for assignments that were of limited duration and that the claimants were aware of this at the time they were hired. Human Resources has also, on several occasions, argued the District's position in front of an Administrative Law Judge, who is a neutral third party responsible for adjudicating any appeal filed by an employer. In every instance, the District has not prevailed. Staff has sought legally compliant methods on how to mitigate the financial impact of claims that should, in staff's opinion, be denied based on the EDD's own eligibility criteria. As a result, Human Resources currently details the beginning date and the anticipated end date on every Personnel Action Form (PAF) that the employee is required to sign at the time of hire, and this form is provided to the EDD if and when that employee should file a claim. Also, the formal offer letter printed on District letterhead to candidates within these categories will now clearly state that they are being offered "temporary" limited duration employment. These actions will acknowledge that the employee was aware, at the time of hire, that the assignment was of a limited duration. Staff will continue to monitor and to respond to all claims and implement any other measures that would protect the District from these types of claims.
