ISSUE: A resolution of the Board of Directors is required to accept grant deeds and offers of dedication for sanitary sewer easements and to authorize execution of quitclaim deeds to convey or remove any real estate interest to or from Central San and to record the documents with the Contra Costa County Recorder. BACKGROUND: Located in the Greenbrook neighborhood of Danville, east of Camino Ramon and north of El Capitan Drive, Glennmont, LLC, a California limited liability company (Developer), planned and constructed a community of nine condominium homes as part of Subdivision 9204 known as Brookstone Lane. With this sewer project (Job 6600) the Developer changed the direction of the public sewer. Initially the vacant lot sewered to the south to EI Capitan, but now the new condominium project sewers to the north to Silver Chief Way. With this change in direction, a former public sewer main was formally abandoned and the existing sanitary sewer easements (SSE), a Grant of Easement (6951 OR 110) and a Final Map SSE Offer (Lot 2 of 154 M 13), have become obsolete. The Board of Directors historically accepts offers of dedications of SSEs and authorizes execution of quitclaim deeds by resolution. Upon acceptance and recording of this resolution, Central San will have the necessary land rights for the new and abandoned public sewers as required for construction and acceptance of sewer project Job 6600. Strategic Plan: Adoption of this resolution will further advance District Goal 6, maintain a reliable wastewater infrastructure, as defined easements are necessary to effectively and efficiently maintain and operate public sewers on private property. ALTERNATIVES/CONSIDERATIONS: None. FINANCIAL IMPACTS: The offer of dedication for SSEs was acquired at no cost to Central San and the costs and fees associated with the quitclaim deeds have been paid by the Developer. COMMITTEE RECOMMENDATION: This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION: Adopt a resolution: 1) Accepting an offer of dedication of sanitary sewer easements as depicted on Final Map for Subdivision 9204 (523 M 21-24); 2) Authorizing the President of the Board of Directors and the Secretary of the District to execute quitclaim deeds to the property owners listed in Attachment A of Resolution for the Grant of Easement (6951 OR 110); 3) Authorizing the President of the Board of Directors and the Secretary of the District to execute a quitclaim deed to the property owner listed in Attachment B of Resolution for the Final Map SSE Offer (Lot 2 of 154 M 13); and 4) Authorizing staff to record said documents with the Contra Costa County Recorder. Proposed Resolution Page 2 of 2 ATTACHMENT 1 RESOLUTION NO. 2016-03 ADOPT A RESOLUTION ACCEPTING AN OFFER OF DEDICATION OF SANITARY SEWER EASEMENTS FROM GLENNMONT, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, AS RELATED TO CAMINO RAMON CONDOMINIUM PROJECT, TOWN OF DANVILLE, SUBDIVISION 9204, AND AUTHORIZING EXECUTION OF QUITCLAIM DEEDS TO PROPERTY OWNERS AS RELATED TO JOB 6600 AND RECORDING OF THE RESOLUTION WHEREAS, As part of Sewer Job 6600, Glennmont, LLC, a California limited liability company, (Developer) offered for dedication to Central Contra Costa Sanitary District (Central San) sanitary sewer easements (SSE) that are lying within the Town of Danville as shown on Final Map titled "Subdivision 9204, Camino Ramon, A One Lot Subdivision for Condominium Purposes", that was filed on April 23, 2015 in Book 523 of Maps at Page 21 as Document Series No. 2015-0077477 (New SSE Map) in the Recorder's Office of Contra Costa County. WHEREAS, with same Sewer Job 6600, Developer abandoned an existing public sewer main, which has made the following two existing SSEs obsolete: Existing Grant of Easement to be Quitclaimed — Located at Brookstone Lane & Lot - Line Portion of 407 El Capitan Grant of Easement recorded May 22, 1973 in Book 6951, Page 110 of Official Records in the Recorder's Office of said county. (Acquired with Sewer Job 2214, Parcel 5.) Existing SSE Map Offered to be Quitclaimed — located at 407 El Capitan Drive 10' wide SSE as shown on Lot 2 of Final Map titled "Subdivision 4336, Danville Station Unit 1" that was filed on February 7, 1973 in Book 154 of Maps at Page 13 in the Recorder's Office of said county. (Acquired with Sewer Job 2214, Tract Map offer.) NOW, THEREFORE, BE IT RESOLVED by the Board of Directors (Board) of Central San as follows: THAT Central San hereby accepts the offer of dedication of SSEs as more particularly described above as New SSE Map; and THAT Central San hereby consents to the execution and recording of quitclaim deeds as more particularly described above as "Existing Grant of Easement to be Quitclaimed — Located at Brookstone Lane & Lot -Line Portion of 407 El Capitan" to the property owners listed in Exhibit A; and THAT Central San hereby consents to the execution and recording of a quitclaim deed as more particularly described above as "Existing Map Offered to be Quitclaimed — located at 407 El Capitan Drive" to the property owner listed in Exhibit B; and THAT the President of the Board and the Secretary of the District are hereby authorized to execute said documents for and on behalf of Central San; and Resolution No. 2016-0'/$ Central Contra Costa Sanitary District Page 2 of 2 THAT staff is authorized to record the documents in the office of the Recorder of Contra Costa County.
