ISSUE: On October 25, 2016, seven (7) sealed bids were received and opened for the
District -Wide Nondestructive Potholing of Underground Utilities. The Board of Directors
(Board) must award the contract or reject bids within 50 days of the bid opening.
Authorization is also required for the General Manager to execute the Contract
Documents subject to SUBMITTAL requirements.
BACKGROUND: The work supports the Capital Improvements Program which aligns
with the District's Strategic Plan, specifically Goal No. 5, which is "Maintain a Reliable
Infrastructure."
In total, District staff authorizes up to 200 potholes each year during the design of
collection system renovation projects. Potholing exposes underground utilities along the
proposed sewer alignment at points of potential conflict. The pothole results are used to
evaluate alternatives during design and to minimize change orders during construction.
Potholing includes pavement restoration and traffic control, as required by the permitting
agencies.
Bidding the nondestructive potholing services on a periodic basis results in a lower
overall cost and reduces paperwork associated with negotiating and issuing separate
individual contracts per project. The bid request establishes a unit cost for each portion
of the work while obtaining the lowest overall cost for the District.
District staff prepared the specifications and bid documents for this contract. The
Engineer's estimate is $150,000 per year, with an optional extension for two one-year
periods, totaling $450,000. The project was advertised on October 12 and 17, 2016.
Seven (7) sealed bids ranging from $148,910 to $282,800 were received and publicly
opened on October 25, 2016.

The Capital Projects Division reviewed the bids and determined that Overmiller, Inc.
DBA: Roto -Rooter Sewer Service was the lowest responsive and responsible bidder
with a bid amount of $148,910. District staff may extend the contract for two additional
one-year periods at the bid prices, provided the initial work is successful and the prices
are still favorable to the District. A summary of bids received is shown in Attachment 1.
CEQA: Staff has concluded that this project is exempt from the California
Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15262,
since it will provide information for design of sewer improvements and will not have a
legally -binding effect on later activities. Approval of this project will establish the Board
of Directors' independent finding that this project is exempt from CEQA.
FINANCIAL IMPACTS: Approximately $148,910 per year with the option to extend for
two additional one-year periods, totaling $446,730 for three years. The contract will be
paid under the budgeted sewer renovation projects and other projects in the
Board -adopted Capital Improvement Program.
ALTERNATIVES/CONSIDERATIONS: Reject all bids and rebid the contract, or issue
individual contracts each time nondestructive potholing of underground utilities is
needed. Neither option is recommended.
COMMITTEE RECOMMENDATION: The Engineering and Operations Committee
reviewed this subject at the meeting on November 8, 2016, and recommended approval
to award the contract.
RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Find that the project is exempt from CEQA,
2. Award a construction contract in the amount of $148,910 for the District -Wide
Nondestructive Potholing of Underground Utilities to Overmiller, Inc. DBA:
Roto -Rooter Sewer Service, the lowest responsive and responsible bidder, and
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements, and
4. Authorize the General Manager to execute up to two additional extensions for a
total Contract amount of $446,730.
