Petit—Director of Engineering &Technical Services K.Alm Roger S.Bail 9 g Counsel for the Distri General Manager ISSUE: A resolution of the Board of Directors is required to accept deeds, grants, or offers of dedication to convey any real estate interest to the District and to record the documents with the Contra Costa County Recorder. RECOMMENDATION: Adopt a resolution accepting an offer of dedication for sanitary sewer easements and authorizing staff to record the document with the Contra Costa County Recorder. FINANCIAL IMPACTS: The offer of dedication for sanitary sewer easements was acquired at no cost to the District. ALTERNATIVES/CONSIDERATIONS: None. BACKGROUND: The Ryan Terrace Project for Condominium Purposes (Subdivision 9323) is located at the end of Ryan Industrial Court off Old Crow Canyon Road in San Ramon. This location was an existing sanitary sewer easement for a pipeline that was never constructed. Prior to developing the site, property owner Taylor Morrison of California, LLC (Taylor Morrison), requested the District quitclaim this abandoned easement, which the Board approved on May 7, 2015, and the quitclaimed deed was executed and recorded by the District on May 14, 2015 as Document Number 2015- 0094932. Since that time the new public sewer for this project was constructed under Job 6566 and Taylor Morrison offered for dedication the corresponding sanitary sewer easements with Final Map (Subdivision 9323) filed on June 4, 2015 as Series Number 15-0112898. ADOPT A RESOLUTION ACCEPTING AN OFFER OF DEDICATION FOR SANITARY SEWER EASEMENTS FROM TAYLOR MORRISON OF CALIFORNIA, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, AS RELATED TO RYAN TERRACE CONDOMINIUM PROJECT, SAN RAMON, SUBDIVISION 9323, JOB 6566 AND AUTHORIZING RECORDING THE RESOLUTION The sewer work has been accepted by staff and upon acceptance and recording of the attached resolution the District will have the necessary land rights for the sewers associated with Job 6566. Board action is needed to accept the new permanent sanitary sewer easements from the property owner named above. Strategic Plan: Adoption of this resolution will further advance District Goal 6, maintain a reliable wastewater infrastructure, as defined easements are necessary to effectively and efficiently maintain and operate public sewers on private property. In addition, these easements meet the requirements as outlined in Title 7, Real Property and Improvements, of the District Code and Section 8, Property Rights of Wastewater Facilities, of the latest Standard Specifications for Design and Construction of Sewers. RECOMMENDED BOARD ACTION: Adopt a resolution: (1) accepting an offer of dedication for sanitary sewer easements as depicted on that certain Final Map (Subdivision 9323) filed on June 4, 2015 as Series Number 15-0112898; and (2) authorizing staff to record the resolution with the Contra Costa County Recorder. Proposed Resolution Page 2 of 2 ATTACHMENT 1 RESOLUTION NO. 2016- ADOPT A RESOLUTION ACCEPTING AN OFFER OF DEDICATION FOR SANITARY SEWER EASEMENTS FROM TAYLOR MORRISON OF CALIFORNIA, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, RELATED TO RYAN TERRACE CONDOMINIUM PROJECT, SAN RAMON, SUBDIVISION 9323, JOB 6566 AND AUTHORIZING RECORDING THE RESOLUTION (APNs: 208-280-017 and 208-280-018) BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (District) as follows: THAT as a condition of development, Taylor Morrison of California, LLC (Taylor Morrison), offered to the District sanitary sewer easements lying within two parcels located off of Ryan Industrial Court in the city of San Ramon, county of Contra Costa, state of California, as shown on that certain Final Map (Subdivision 9323) filed on June 4, 2015 as Series Number 15-0112898 in the office of said County Recorder; and THAT District staff has accepted the public sewers constructed as a part of Job 6566 and are located within said sanitary sewer easements; and THAT District hereby accepts said offer of dedication for sanitary sewer easements as shown on said Final Map; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said documents for and on behalf of the District; and THAT staff is authorized to record this resolution in the office of the Recorder of Contra Costa County.
