ISSUE: On September 16, 2016, four (4) sealed bids were received and opened for the
construction of the Kiewit Property Paving Project, District Project 7350. The Board of
Directors (Board) must award the contract or reject bids within 50 days of the bid
opening. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements.
BACKGROUND: On April 21, 2016, the Board approved a contingency project to
expand the residential recycled water fill stations and pave the Kiewit property. District
staff has completed the planning and design of the future residential fill stations in
coordination with the required road paving per the Contra Costa County Planning and
Public Works Department requirements. After a review of several sites, staff
determined that the best option to expand the residential fill station program is at the
Kiewit property. The other sites, which include the Treatment Plant or the Imhoff Place
frontage road, or the Household Hazardous Waste Facility, had several limitations or
required costly improvements to implement.
Due to the various permit conditions for the residential fill improvements at the Kiewit
property, such as storm drain systems and street modifications, along with residential
recycled water demand not increasing as previously anticipated, staff proposes to delay
the residential fill station expansion to a future date.
While the residential fill station expansion is on hold, the Kiewit Property Paving Project
must be done to comply with Contra Costa County requirements for the property's Land
Use Permit. This project will replace the west driveway with a street entrance and pave
the access road to the new commercial 1911 station at the District's Kiewit property (see
Attachment 1). The improvements will allow for traffic on the property to be managed
safely for commercial recycled water customers and other potential site users.
District staff prepared the plans and specifications for the project. The Engineer's
estimate for construction of the Kiewit Property Paving Project, District Project 7350, is

$155,000. This project was advertised on August 31 and September 5, 2016. Four (4)
sealed bids ranging from $114,400 to $149,779 were received and publicly opened on
September 16, 2016. The Engineering Department conducted a technical and
commercial review of the bids and determined that Breneman, Inc. is the lowest
responsive bidder with a bid amount of $114,400. A summary of bids received is shown
in Attachment 2. The District will administer the construction contract and will provide
contract administration, inspection, survey, office engineering, and submittal review.
CEQA: Staff has concluded that this project is exempt from the California
Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15301(b)
since it involves a minor alteration to an existing publicly owned facility. Approval of this
project will establish the Board of Directors' independent finding that this project is
exempt from CEQA.
FINANCIAL IMPACTS: The total project cost is anticipated to be $300,000, which
includes planning, permitting, design, bid price, contingency, and construction
management as shown in Attachment 3. The total estimated project budget authorized
by the Board on April 21, 2016 is $450,000, and was included in the Fiscal Year
2016-17 Capital Improvement Program.
ALTERNATIVES/CONSIDERATIONS: Reject all bids, which is not recommended
since the paving is required based on the existing land use permit for the parcel.
COMMITTEE RECOMMENDATION: The Engineering and Operations Committee
reviewed this project at its meeting on September 22, 2016, and recommended award
of the project.
RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Find that the project is exempt from CEQA,
2. Award a construction contract in the amount of $114,400 for the construction of
the Kiewit Property Paving Project, District Project 7350, to Breneman, Inc., the
lowest responsive and responsible bidder, and
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements.
