Bailey Counsel for the District General Manager ISSUE: On May 19, 2016, the Board of Directors (Board) authorized the General Manager to solicit and negotiate a construction contract for the Pump and Blower Building Seismic Upgrades, District Project 7291. On September 13, 2016, three sealed proposals were received and evaluated. The Board must award the contract or reject proposals within 50 days of receiving the proposals. Board authorization is also required for the General Manager to execute the Contract Documents subject to SUBMITTAL requirements, and amend a professional service agreement in an amount greater than $100,000. BACKGROUND: In January 2008, California adopted the 2007 California Building Code (2007 CBC). Among the updates in the 2007 CBC were significant changes to seismic design. In 2009, a seismic evaluation of the treatment plant facilities was completed and included a recommendation to bring the Pump and Blower Building up to higher seismic design standards. The Pump and Blower Seismic Upgrades will update the Pump and Blower Building and Machine Shop to meet current seismic design standards. The scope of work includes demolition of existing walls, installation of reinforced concrete shear walls, installation of buckling restrained braces with associated foundations, and structural steel work. Complete Project Solutions (CPS), the project structural engineering consultant along with MWH Global, the electrical -mechanical engineering consultant, and District staff prepared the plans and specifications for the project. On March 10 and 16, 2016, the project was advertised for public bid and (0) zero bids were received on April 27, 2016. District staff proposed to solicit proposals and select a contractor by an alternate method, by requesting for Guaranteed Maximum Price (GMP) Page 1 of 5 rL POSITION PAPER Board Meeting Date: October 6, 2016 Subject: AWARD A CONSTRUCTION CONTRACT AND AUTHORIZE THE GENERAL MANAGER TO EXECUTE CONTRACT DOCUMENTS SUBJECT TO SUBMITTAL REQUIREMENTS WITH MANITO CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE PUMP AND BLOWER BUILDING SEISMIC UPGRADES, DISTRICT PROJECT 7291; AND AUTHORIZE AN AGREEMENT AMENDMENT WITH COMPLETE PROJECT SOLUTIONS proposals for construction of the project. District Legal Counsel has reviewed the project and is confident the District has met the statutory obligations for bidding, and the District can now enter into a negotiated contract directly with a Contractor. Staff hired Ewing Construction Services (ECS) to provide engineering services related to developing the GMP procurement and construction contract documents, in accordance with Legal Counsel review. A request for statement of qualifications was sent on May 31, 2016 to several Contractors, some of which were interested parties from the original planholder's list and others from private or commercial contractors that specialize in this type of project and who do not normally participate in the public low bid process. Out of six contractors, four continued into the GMP proposal stage. The request for proposal was sent on August 5, 2016, and three proposals were received September 13, 2016 and scored by the District's selection committee. Proposals were issued by Overaa Construction, Manito Construction, and Roebbelen. Selection was based on a detailed scoring system that included qualifications and GMP pricing. The overall weight of the scores consisted of 40% on qualifications and 60% on price. The successful proposer, which also was the lowest GMP price, is Manito Construction, Inc. District staff will administer the construction contract and provide construction management, oversee consultant services, and coordinate activities with Plant Operations. Staff also recommends retaining CPS to provide services during the construction phase, including reviewing shop drawings and submittals, responding to design questions, performing site visits to verify compliance with the design, inspection, and other related activities. An as -needed construction support services agreement amendment with a cost ceiling of $345,000 is recommended for CPS. The new cost ceiling for the CPS agreement, including the original amount, will be $588,400. CEQA: Staff has concluded that this project is exempt from CEQA under District CEQA Guidelines Section 15302, because it involves replacement of existing sewer facilities at substantially the same locations and with the same purpose and level of activity as the facilities being replaced. Any capacity increases are for non -growth inducing, wet weather purposes. This project also is exempt under District CEQA Guidelines Section 15061(b)(3), since it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. This certainty is based on the District's past experience with numerous sewer construction projects of this nature, the relatively short distances involved, and the District's mitigating construction specifications. These specifications are standardized general and special conditions that are made part of the project bid documents to address environmental considerations, such as protecting trees and riparian areas, as well as compliance with applicable federal, state, county, district, municipal and local laws, ordinances, orders, Page 2 of 5 POSITION PAPER Board Meeting Date: October 6, 2016 Subject: AWARD A CONSTRUCTION CONTRACT AND AUTHORIZE THE GENERAL MANAGER TO EXECUTE CONTRACT DOCUMENTS SUBJECT TO SUBMITTAL REQUIREMENTS WITH MANITO CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE PUMP AND BLOWER BUILDING SEISMIC UPGRADES, DISTRICT PROJECT 7291; AND AUTHORIZE AN AGREEMENT AMENDMENT WITH COMPLETE PROJECT SOLUTIONS and regulations. Approval of this project will establish the Board of Directors' independent finding that this project is exempt from CEQA. FINANCIAL IMPACTS: The total project cost is anticipated to be $6,782,000, which includes planning, design, bid price, contingency, and construction management as shown in Attachment 2. This project is included in the Fiscal Year 2016-17 Capital Improvement Budget (CIB) with a total estimated project budget of $5,953,000, therefore, contingency funds are required. There is currently $1.45 million in the CIB contingency account, and a budget transfer of $829,000 is needed to fund this project. This will leave $621,000 in the FY 2016-17 contingency account. ALTERNATIVES/CONSIDERATIONS: Reject all proposals, which is not recommended. COMMITTEE RECOMMENDATION: The Engineering and Operations Committee reviewed this project at its meeting on September 22, 2016, and recommended award of the project. RECOMMENDED BOARD ACTION: Staff recommends the following: 1. Find that the project is exempt from CEQA, 2. Award a construction contract in the amount of $4,887,800 for the construction of the Pump and Blower Building Seismic Upgrades, District Project 7291, to Manito Construction, Inc., the selected proposer, 3. Authorize the General Manager to execute the Contract Documents subject to SUBMITTAL requirements, 4. Authorize the General Manager to execute an agreement amendment with Complete Project Solutions to increase the cost ceiling from $243,400 to $588,400 to provide as -needed construction support services, and 5. Authorize the General Manager to transfer $829,000 from the CIB contingency account to the Pump and Blower Seismic Upgrades, District Project 7291. Attached Supporting Documents: 1.
