SUBJECT: June 1, 2005 Finance Committee Meeting
There were several outstanding questions from the last Board Finance Committee
meeting which required additional staff research. The questions and answers are
provided below:
1. Page 20, 155817 Recourse communications —What staff position was
advertised?
This was a generic ad in USA Today, which was circulated in the Bay area. It
was a special issue on diversity. We provided contact information about the
District in the ad. (See Attachment)
2, Page 22, 155832 Sonnikson and Stordahl construction What work was
done by CSO in Clyde's
The District was replacing old clay sewer pipe in Clyde. The end "apron") of two
resident's driveways had to be dug up to reach the pipe because the sewer
mains in Clyde run down the side of the streets, not down the middle. Although
the easements were conveyed to the District when the area was annexed to
CCCSD, the property owner has reasonable rights to use the property for such
things as landscaping, sidewalks, driveways, etc. Because of this, we restore the
surface improvements that the District disturbs. The repaving was contracted out
to Sonnikson and Stordahl Construction.
3. Page 26, 27894 I.M.P.A.C. Government Services What were the large
purchases charged to capital on the Procurement Card?
The first charge for$3,414.01 was for two small sewer machines and a machine
hoist to lift these machines onto a truck. These will be used for sewer problems
on the District's premises instead of using Roto Rooter, where possible.
The second charge for $7,378.98 was for three laptop computers. These were
purchased through the MIS Capital Budget. Two of the computers are a special
size to accommodate use in the CSO cleaning trucks. The third computer was a
replacement computer for the Pump Station Superintendent. This is a wireless
computer with high speed connect which allows SCADA access from remote
locations.

The attached is a copy of the vehicle accident report for Mr. Kelly Weir, Assistant Land
Surveyor. The Survey Section is within the Engineering Department. Mr. Lucey had
requested a copy of the report at a past Committee meeting. I apologize for the delay
in submitting you the information. Mr. Weir received a Discussion Record regarding the
accident. As a minimum, employees at fault for an accident receive a Discussion
Record. Discipline is commensurate to the degree of negligence and severity of the

Vehicle Accident Narrative
9/03/04
Driver Kellv Weir
The accident occurred at approximately 10:30 AM on Friday 9/03/04 while
performing a Survey in the vicinity of Pleasant Hill BART near Jones
Road/Coggins Road. I was exiting the southern most parking lot of Bart heading
east across the street into the Landscaping site to the east of the road. There is
a temporary 0' Chain Link fence and gate set up on the East side of the road at
back of curb directly across the street from the exit 1 was .makin While passing

through the gate I began to make a left tum north into the construction site and
struck the gate with the drivers side of truck 210 just behind the cab near the0 as
filler. An employee from the landscape company immediately came over to
assist opening the gate however the gate was bound up on the truck where it had
been struck. I was concerned about the rear of the truck being out in traffic so as
the employee was pushing.pn the fence I pulled forward and had to gas it to
break free from the gatepost. Backing the truck up would have damaged the cab
and put the rear of the truck out into traffic so I elected to pull forward as to
minimize damage to the truck. I could see the employee was startled by me
pulling ahead and causing the gate to shake. Once free from the gate I asked
the Employee if he was ok. He really didn't say anything, he seemed pretty mad.
To the best of my knowledge he'is ok, as he walked over to his truck and
continued work: In retrospe6i I should have better communicated my intentions
to pull forward to the Landscape Employee. It's obvious now that he was not
expecting me to pull forward suddenly and he was understandably startled. In
the future I would make sure that my intentions are clear and take the necessary
time to assess the situation at hand as to avoid situations like this in the future.
The gate does not appear appreciably damaged by me it is just more bent that it
already was, it appeared to have been struck previously. I apologize for any
inconviences this may have caused the district or the Landscape Employee and
will remain more aware as a result of this incident.

Accident Investigation
Tuesday, September 07, 2004
8:30 a.m.
I went to the Valley Crest Landscaping construction site in the Iron Horse Trail
(old SPRR R/W) east of Pleasant Hill BART this morning to investigate a single
vehicle accident involving Truck# 210 that occurred on Friday, September 03,
2004 at approximately 10:00 a.m. Kelly Weir hit a gate post of a temporary
construction fence while driving Truck #210. The driver's side of the truck was
damaged. There were no passengers. I observed that the northerly post at the
gate where the accident happened was bent, but don't believe that District Truck
# 210 caused the damage. The panel to the rear of the driver's compartment is
the only portion of the truck to sustain damage and it is bent in. The truck is not
built strongly enough to have damaged the fence.
An equipment operator named Rudy stopped his machine to see if I needed help.
I asked him if he had seen the accident on Friday. He had and informed me that
the driver (Kelly Weir) drove `much too fast' and `seemed really angry. He added .
that the foreman had waved at the driver and was trying to open the gate wider
when the driver jammed on through. He said that the gate had hit the foreman in
the leg.
I searched the job site and found the Project Superintendent, John Buell. He had
not witnessed the accident, but had heard about it. The foreman, Widmark Tellez
had not filed an accident report. I explained to John that I was investigating the
accident and was very concerned that one of my workers might have behaved in
an unsafe fashion. John called Widmark to ask him to talk to me and expiain
what happened. John added that any damage to the fence was there prior to the
accident on Friday.

called Widmark Tellez and asked him what had happened on Friday. He said
that the CCCS D van (#188) had already entered the construction site at the gate
which was only open on one side. The truck (#210) did not wait until the van
pulled all the way through, but went around it to the left to enter through the half
gate opening. The truck hit the gate. At this point Widmark waved at the driver
and ran to open the gate wider. He said that the driver saw him, but `either wasn't

paying attention or just didn't care' because he `stepped on it' further damaging
the truck and hitting Widmark with the fence.
Widmark Tellez has agreed to sign a statement attesting to what happened.
I have apologized to both John Buell and Widmark Tellez for this incident and
have said that the District takes unsafe behavior very seriously.

9:30 a.m.
I spoke on the telephone with Tom Phillips, driver of the van that was on-site
when the accident occurred. Tom related his actions at the site that morning and
also what he observed.
Tom saw that the gate where the accident later occurred was only partially open
and elected to enter the site further north at another gate that was fully open. He
drove into the site and then returned to the first gate and parked the van about
100 feet away from, and directly across from the gate. He then exited the van to
wait for Kelly. He was watching as Kelly entered the site.
Tom said there was either equipment or some obstruction that made a sharp turn
to the left necessary as Kelly entered the partially open gate. Kelly made the turn
and hit the gate with the rear panel of his truck. He realized that he hit the gate
and briefly hesitated. At this point the guy from the landscaping company ran
over to tell him to back off, that he would open the gate. Kelly saw him, but just
blasted through the gate. Tom said Kelly seemed angry.
