(Handout) June 21 Meeting with Central San Board of Directors Regarding the Satellite Water Recycling Facility (SWRF) proposed by Diablo Country Club. Thank you for allowing us to address the Board. I have copies for each Board member of a letter that was sent to DCC with copies to Mr. Causey and Mr. Pilecki from ourselves and a few of our neighbors. There have been some additional people sign since it was originally submitted. It states, that for a variety of reasons and concerns, we don't believe the SWRF should be placed adjacent to residential properties. We want a win/win/win situation for Central San, DCC and the Club neighbors. At this time, we don't object to the project itself, only to placing a treatment plant next to existing homes. If this project is to be used as a model for other installations, then it only makes sense to create proposals that are not going to be vehemently opposed by those living nearby. Placing a plant next to someone's home is going to be objected to by everyone, everywhere, every time. Therefore, developing a fundamental policy that states clearly that that will not happen is the first step toward creating an environment where golf courses can make a joint proposal with you that is less likely to result in massive neighborhood objections. We have received a response from DCC to our request to have Alternative 1 removed from consideration. In it, the Club stated they would comply with all laws and regulations as well as an EIR and that several sites were under consideration. However, they would not remove Alternative 1 from consideration even though they are now fully aware that that site is not acceptable in any way to their neighbors. When we met with Mr. Corderio and Mr. Salvo, Mr. Salvo was very clear that the only site they were seriously considering was Alternative 1, directly behind our home. Since DCC seems insistent that Alt. 1 is their site of choice, would it be possible for Central San to establish a policy or regulation that any proposed SRWF site must be 1,000 feet or more from all properties with existing residences? In any case, we again ask that you tell DCC that Alternative 1 is not an acceptable location and is permanently off the table for this project. We believe this to be simple common sense and necessary to show respect for those living next to the Club property. DCC has declined to do this, so we hope that Central San will do so. If DCC and Central San will not take this common sense approach to siting the plant, then we have no choice but to fight this project in every single way we can. On behalf of the Diablo Country Club, I welcomed the opportunity to meet with you in-person and we remain open to hearing your concerns and to addressing any additional questions not already answered during our meeting with you and the other residents on Fairway Drive. Although we are in the earliest phase of project planning, we are committed to providing information on the project as it becomes available through meetings and information for the community, including for the residents on Fairway Drive. We are also working closely with Central Contra Costa Sanitary District (District), an experienced agency in these matters, on an agreement to continue collaborating on the evaluation of the project, including the environmental review process, which will be led by the District. If an implementable project is found through the environmental review process, the project design will begin and more information will become available through our outreach efforts. As discussed during our in-person meetings several weeks ago, the Club has multiple SWRF sites under consideration. The Club and the District will follow all applicable laws and regulations in the execution and management of the project including complex analysis of each site alternative as part of the environmental review process. This analysis will include a public comment process on the project and each alternative site, and we welcome your input. Thank you again for providing input on the project. (Copy attached for reference.) In that letter, we expressed our concern about the proximity of the proposed SWRF to our homes. We asked for 2 specific follow ups: 1. To formally remove Alternate Site 1, or any site near our homes, from your proposal. 2. To notify us in writing of any further meetings on this topic, and to send us copies of any meeting minutes. These written communications are a requirement for any proposed recycled water project per California Water Code Section 12523. We respectfully request an email response by July 18, so that we can make a determination as to whether further action will be required on our part regarding this project. Diablo Country Club Subject: Formal request that you NOT build a sewage treatment plant adjacent to our homes First, we would like to thank Messrs. Salvo and Cordeiro for meeting individually with a number of Fairway Drive residents over the past couple of months to discuss the topic of the Sewage Treatment Plant that the Diablo Country Club is planning to install. I hope it was as helpful for them to hear our concerns as it was for us to get an update on the planned project. While we understand the importance to the Club of having an uninterrupted supply of water, we have several serious concerns about the current plan, especially our understanding that the primary location of this plant will be at a location called "Alternative Site 1" (see attached Map from Central Contra Costa Sanitary District) immediately adjacent to one or more homes on Fairway Drive in Danville. Our concerns about the plant include, but are not limited to, the following: 1. Noise nuisance from installation, regular operation, and periodic required maintenance 2. Odor nuisance from installation, regular operation, and periodic required maintenance 3. Potential for unhealthy exposure to airborne contaminants during installation, regular operation, and periodic required maintenance 4. Potential for unhealthy exposure to waterborne contaminants during installation, regular operation, and periodic required maintenance 5. Potential for unhealthy exposure to raw sewage, airborne contaminants and/or waterborne contaminants in the case of operational failure, earthquake, flood or other incident, human error, accident or negligence. 6. Potential for serious or even fatal injuries to nearby residents in the case of operational failure, earthquake, flood or other incident. human error, accident or negligence. (see attached for a recent sample of articles. Dangerous and even lethal accidents are not uncommon at wastewater treatment plants). 7. Damage to property values for our family and neighbors based on the above (Note: The very existence of a Sewage Treatment Plant this close to a home, regardless of how it operates, would very likely need to be disdosed in Section C.1. of the California REAL ESTATE TRANSFER DISCLOSURE STATEMENT which asks about "Neighborhood noise problems or other nuisances". This would have an immediate and damaging impact on property values. 8. Damage to quality of life for our family and neighbors based on the above We were particularly alarmed to learn that the current plan is recommending the plant be located at Alternative Site 1. This is the only site identified that is directly adjacent to a residence, and in fact there are 5 residences, within 300 feet - all of which are likely to be both downwind and downhill, further increasing the risks above. Is it even legal to locate a Sewage Treatment plant this close to residence and also this close to the border of a neighboring town (the boundary in question separates Danville from Diablo)? Alternative Sites 2 and 3 do not appear to be adjacent to any Danville homes or the Danville border, and it appears likely that the Club could consider other locations on the 200 acre property that could keep the Sewage Treatment Plant even further from nearby homes. To be clear, we could and would support a plan for Diablo to secure and maintain a reliable source of water. However, for the reasons stated above, we urge Diablo Country Club to immediately go on record and eliminate Alternate Site 1, or any site that is near our residences, from consideration, and will do everything in our power to oppose the project unless and until those modifications are made to the current plan. Additionally, as required by by California Water Code Section 13523. we hereby request that we be consulted during each step of this project, and we request written notice (by mail or email) of all meetings or hearings on this matter, and written copies of meeting minutes. Given the level of transparency and cooperation that Messrs. Salvo and Corderio have demonstrated so far, and their sincere commitment to find a "win/win'. solution, we remain optimistic that a plan can be found that can address our issues while still allowing the Club to pursue their stated goals.
