ISSUE: The District Code requires that a public hearing be held prior to Board
consideration of revisions. Additionally, District Code and state law require that a public
hearing must be held to receive public comment on any proposed increases to Capacity
Fees and Environmental and Development-Related Rates and Charges.
BACKGROUND: Staff has completed its annual review of the District's Capacity Fee
and Environmental and Development-Related Rates and Charges and has concluded
that it would be appropriate to revise these fees. The recommended changes to the
Capacity Fee account for changes in the value of District assets and the number of
customers. The recommended changes to the Environmental and Development-
Related Rates and Charges reflect changes to the District's actual cost to provide these
services.
District Code Chapter 6.30 refers to these services as the "Schedule of Environmental
and Development-Related Rates and Charges." To avoid confusion with sewer service
rates, staff recommends amending District Code Chapter 6.30 to retitle the schedule to
"Schedule of Environmental and Development Fees and Charges."
A coordinated outreach program to inform and solicit input from interested customers,
including the Building Industry Association of the Bay Area, regarding both the
proposed Capacity Fees and the proposed Environmental and Development-Related
Rates and Charges will be conducted by staff before the public hearing on June 2,
2016.

ALTERNATIVES/CONSIDERATIONS: The Board of Directors may decline to establish
the recommended public hearing date or may elect to choose a different date; however,
a public hearing must be held to amend District Code Chapter 6.30, and revise
Capacity Fees and the Schedule of Environmental and Development-Related Rates
and Charges. If the public hearing is held on June 2, 2016, and if the new fees are
approved by the Board, the new fees will become effective July 1, 2016.
FINANCIAL IMPACTS: None related to this action.
COMMITTEE RECOMMENDATION: The setting of these public hearings was not
reviewed by a Committee.
RECOMMENDED BOARD ACTION: Set June 2, 2016 at 2:00 p.m. as the date and
time for a public hearing to consider:
• Adopting a codified ordinance amending District Code Chapter 6.30 — Schedule
of Environmental and Development-Related Rates and Charges;
• Adopting an uncodified ordinance amending the Schedule of Environmental and
Development-Related Rates and Charges; and
• Adopting an uncodified ordinance amending the Schedule of Capacity Fees.
Four affirmative votes will be required to adopt the above uncodified ordinances on
June 2, 2016.
