ISSUE: A resolution of the Board of Directors is required to authorize ement
exchanges for sewer purposes, which include accepting grants of easement,
authorizing execution of quitclaim deeds, and allowing documents to be recorded with
the Contra Costa County Recorder.
BACKGROUND: Property owner Moraga Country Club Homeowner Association
(Moraga Country Club), a California corporation, located at 1600 Saint Andrews Drive in
the town of Moraga (APN 257-440-001), requested that the District approve the
relocation of a public 12-inch sewer main on Moraga Country Club's property to
accommodate expansion of their clubhouse facilities. The District concurred and the
sewer realignment consisted of installing a new sewer main and abandoning a portion
of the existing sewer; this work was designed and installed per District standards at
Moraga Country Club's expense.
Approval of this Board action request will modify the District's land rights to become
coincident with this newly realigned public sewer system. This easement exchange
consists of a Grant of Easement Deed signed by Moraga Country Club for the location
of the new sewer main, and the District's execution of a Quitclaim Deed that will
relinquish a portion of two existing easements where the public sewer has been
abandoned.
Strategic Plan: Adoption of this Resolution will further advance the Goal 6 to maintain a
reliable wastewater infrastructure. Defined easements are necessary to effectively and
efficiently maintain and operate public sewers on private property. In addition, these
easements meet the requirements as outlined in Title 7, Real Property and

Improvements, of District Code and Section 8, Property Rights of Wastewater Facilities,
of the latest Standard Specifications for Design and Construction of Sewers.

ALTERNATIVES/CONSIDERATIONS: None.
FINANCIAL IMPACTS: The necessary documents associated with this easement
exchange, grant of easement and the preparation of the quitclaim deed, were paid for
by Moraga Country Club.
COMMUNITY OUTREACH: District did not initiate community outreach for this sewer
relocation work that was requested by Moraga County Club.
COMMITTEE RECOMMENDATION: This matter was not reviewed by a Board
Committee.
RECOMMENDED BOARD ACTION: Adopt a resolution authorizing the easement
exchange by: (1) accepting the grant of easement deed for sewer purposes from
property owner Moraga Country Club; (2) authorizing the President of the Board of
Directors and the Secretary of the District to execute a quitclaim deed for abandoning a
portion of two existing District sewer easements to said Moraga Country Club; and (3)
authorize staff to record said documents with the Contra Costa County Recorder.

ADOPT A RESOLUTION AUTHORIZING AN EASEMENT EXCHANGE
FOR SEWER PURPOSES BY ACCEPTING A GRANT OF EASEMENT
AND AUTHORIZING EXECUTION OF A QUITCLAIM DEED TO
MORAGA COUNTRY CLUB HOMEOWNERS ASSOCIATION
FOR SEWER REALIGNMENT WORK IN THE TOWN OF MORAGA
AS RELATED TO JOB 6491
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District
(District) as follows:
THAT the District hereby authorizes an easement exchange to correspond with a public
sewer realignment project (Job 6491) on land located at 1600 Saint Andrews Drive, Moraga,
(APN 257-440-001), which is owned by Moraga Country Club Homeowner Association
(Moraga Country Club), a California corporation; and
THAT the District hereby accepts a Grant of Easement (Sewer Purposes) at the location of
the new sewer main constructed with Job 6491 from said property owner, Moraga Country
Club; and
THAT the District hereby consents to the execution of a Quitclaim Deed to said property
owner, Moraga Country Club, for the abandoned public sewer that is located within a portion
of District's existing easements (Parcel 1 —Job 2297, and Parcel 31 - Job 1567);and
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said documents for and on behalf of the District; and
THAT staff is authorized to record the documents in the office of the Recorder of Contra
Costa County.
