ISSUE: On December 10, 2015, four (4) sealed bids were received and opened for the
construction of the Plant Control System UPS Replacement Rebid, District Project
6171. The Board of Directors must award the contract or reject bids within 50 days of
the bid opening. Authorize the General Manager to execute the Contract Documents
subject to SUBMITTAL requirements.
BACKGROUND: The Capital Improvement Budget (CIB) Priority Ranking for this
project is critical and the work aligns with the District's Strategic Plan, specifically Goal
No. 6, which is "Maintain a Reliable Wastewater Infrastructure."
This project will install a new uninterruptible power supply (UPS) for the treatment plant
controls system. The system is critical for supplying stable power to sensitive control
equipment and will replace the existing UPS that is over twenty years old and reaching
the end of its useful life. Replacement is being recommended since the existing UPS
requires an expensive overhaul and a new UPS is highly favorable when compared to
the cost for replacement batteries. In addition, the new UPS design will allow for
additional reliability with future interconnection and bypass capabilities for future
replacement or expansion. The new equipment includes two 30 -kW / 50 -kW frame UPS
modules with rectifiers, inverters, battery chargers, static bypass, and control panels.
The project scope involves the procurement of the equipment and electrical
infrastructure work. The project work area is in the Pump and Blower Building as shown
in Attachment 1.
District staff prepared the plans and specifications for the project. MWH performed a
technical review of the project. The Engineer's estimate for construction is $375,000.
This project was advertised on November 25 and December 2, 2015. Four sealed bids
ranging from $253,000 to $360,302 were received and publicly opened on
December 10, 2015.

The Engineering Department conducted a technical and commercial review of the bids
and determined that D.W. Nicholson Corporation is the lowest responsive bidder with a
bid amount of $253,000. A summary of bids received is shown in Attachment 2.
District staff will administer the construction contract and will provide contract
administration, office engineering, and submittal review. Inspection will be performed by
staff with specialty assistance from one of the District's as- needed inspection
companies.
CEQA: Staff has concluded that this project is exempt from the California
Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15302,
because it involves alteration of an existing sewer facility at substantially the same
locations and with the same purpose and level of activity as the facilities being
replaced. Any capacity increases are for non - growth inducing, wet weather purposes.
Approval of this project will establish the Board of Directors' independent finding that
this project is exempt from CEQA.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
FINANCIAL IMPACTS: The funds required to complete this project, as shown in
Attachment 3, are $356,000. The total project cost of the Plant Control System UPS
Replacement is anticipated to be $406,000, which includes design, rebid costs, bid
price, construction, contingency, and construction management. This project is being
funded under the Equipment Replacement Project included in the Fiscal Year 2015 -16
CIB on page TP -32 with a total estimated project budget of $2.4 million. Staff has
conducted a budget analysis of the Treatment Plant Program budget and concluded
that adequate funds are available for this project.
COMMITTEE RECOMMENDATION: The Engineering and Operations Committee
reviewed this subject at the meeting on November 10, 2015 and December 9, 2015,
and recommended approval to award the construction contract.

RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Find that the project is exempt from CEQA,
2. Award a construction contract in the amount of $253,000 for the construction of
the Plant Control System UPS Replacement Rebid, District Project 6171, to D.W.
Nicholson Corporation, the lowest responsible and responsive bidder, and
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements.
