a) Annual Notices Mailed to Reimbursement Account Holders
The District provides a reimbursement program so that costs of mainline sewer
extensions can be shared among property owners. Each year, in accordance with District
Code, annual notices are mailed to the holders of reimbursement accounts (installers).
This year, a total of 231 annual notices were mailed on October 7, 2015.
Installers were reminded of the need to keep the District informed of any change of
address. Installers were asked to update their information and return the notice to the
District in the prepaid envelopes provided. Having current address information will enable
the District to notify installers when reimbursement fees are collected on their behalf.
Installers were also informed of the expiration dates of their accounts. Staff will continue
to make reasonable efforts to locate installers.
b) LAFCO Removes District Annexation (DA) 186 -Magee Ranch
(Danville) from its Calendar
After several continuances due to pending litigation on the project and its environmental
impact report (EIR), at its October 15, 2015 meeting, Contra Costa Local Agency
Formation Commission ( LAFCO) removed from its calendar DA 186 — Magee Ranch
(Danville), a 410 -acre, 69- parcel boundary reorganization with annexations to the District
and East Bay Municipal Utility District (EBMUD).
On September 11, 2015, the Court of Appeals affirmed the trial court's finding that the
Town of Danville violated the California Environmental Quality Act (CEQA) by failing to
determine whether the Project's impact on bicycle safety was significant. The Court of
Appeals also affirmed the trial court's determination that "underlying zoning," as that
term is used in the General Plan, refers to a property's prior zoning. However, the
Court of Appeals reversed the trial court's determination that defendants violated the
Planning and Zoning Law.
As a result of the Court of Appeals ruling, there is no certified EIR. The Town of
Danville will not be able to proceed with project approvals unless and until corrective
action is taken and a final environmental document is approved.
LAFCO staff consulted with the District, as the applicant, and affected parties (i.e., Town
of Danville, EBMUD, developer), and the parties agree that LAFCO should remove this
item from its calendar. When the environmental review by the Town of Danville is
completed, the District will notify LAFCO that the project is ready to proceed. DA 186 will
then be placed back on LAFCO's calendar and will be subject to re- noticing and a new
public hearing.

CSDA TRANSPARENCY CERTIFICATE
c) District Renews Transparency Certificate of Excellence Offered by
the California Special Districts Association (CSDA)
Two years ago, the District applied for and received its first "Transparency Certificate of
Excellence" offered by the California Special Districts Association (CSDA) Leadership
Foundation. In September, the Secretary of the District submitted an application to the
CSDA to renew the Certificate for another two years.
The CSDA created the certification to promote transparency in the operation and
governance of special districts, and to provide an opportunity for special districts to
showcase their efforts. Three main subject areas are addressed:
• Basic requirements (proof of current ethics training for all Board Members, timely filing
of State Controller's Special Districts Financial Transactions and Compensation
Report, compliance with Brown Act, etc.),
• Website requirements, and
• Outreach /best practices requirements.
Earning the certificate serves as a tangible acknowledgement of the District's
transparency efforts and demonstrates to constituents and other stakeholders the
District's commitment to being open and accessible to them. It signifies the District's
commitment to engage the public and create a greater awareness of the District's
activities. It also demonstrates that the District is adhering to one of its stated Values
( "Transparency in all we do ") in support of its Vision Statement, and is consistent with
Strategic Plan Goals Four (Be an Industry Leader) and Five (Provide Exceptional
Customer Service).
There are about 2,200 special districts in the state of California. Of those, 92 currently
hold the certificate, which is about 4% of all special districts in the state.
The Secretary of the District's Office recently received notice that its Transparency
Certificate of Excellence has been renewed for another two years, through September 30,
2017. The CSDA has issued a press release about the District's renewal, which was sent
to local media on October 23, 2015.
