ISSUE: A resolution of the Board of Directors is required to execute quitclaim deeds
and record the documents with the Contra Costa County Recorder.
BACKGROUND: Located at 963 and 981 Livorna Road on the east side of the
unincorporated area of Alamo the Developer, Orly Homes, LLC, a California limited
liability company, is currently constructing 4 homes located on land, which consists of a
single lot, APN 192 - 210 -011, (Single Lot), and 3 lots, APN 192 - 210 -028, -029, and -
030, (Parcels A, B, and C) from a former subdivision, known as MS 00 -0003 (Parcel
Map), which was recorded October 4, 2004 in Book 185 of Parcel Maps, at Pages 13
and 14, Contra Costa County Records (185 PM 13).
The District was offered a dedication (parcel map offers) for sanitary sewer easements
on the Parcel Map, but the Board of Directors did not accept the dedication. Typically
dedication offers are presented to the Board for acceptance after approval and
acceptance of the newly constructed sewers. As the proposed sewer alignment is
different than the previous sewer plan from 2004, the parcel map offers are now
obsolete. Quitclaim deeds to the property owner of record are required to unencumber
the land of the obsolete parcel map offers.
The new sanitary sewer easements encumber Parcels A and B (most northerly lots of
Parcel Map) and the Single Lot to the west. The Developer, as the owner of record at
the time of recording, signed on October 7, 2015 and recorded on October 9, 2015 a
Grant of Irrevocable Offer of Dedication to the District for sanitary sewer easement
purposes (new offers) in County Recorder's Office as Series Number 2015 - 0210202.

The Developer requested the District expedite quitclaiming of the parcel map offers to
facilitate selling of Parcels A, B, and C to the property owners identified as an
attachment to the corresponding resolution.
Currently the new sewers have been installed and the contractor is completing all
necessary work for Job 6572. After the construction is accepted, staff will return to the
Board to request acceptance of the new offers as permanent sanitary sewer
easements. ,
Strategic Plan: Adoption of this resolution will further advance District's Goal 6 to
maintain a reliable wastewater infrastructure. Defined easements are necessary to
effectively and efficiently operate and maintain public sewers on private property. In
addition, these easements meet the requirements as outlined in Title 7, Real Property
and Improvements, of District Code and Section 8, Property Rights of Wastewater
Facilities, of latest Standard Specifications.
ALTERNATIVES /CONSIDERATIONS: None.
FINANCIAL IMPACTS: None.
RECOMMENDED BOARD ACTION: Adopt a resolution: (1) Authorizing the President
of the Board of Directors and the Secretary of the District to execute three quitclaim
deeds for Offers of Dedication of Sanitary Sewer Easements across Parcels A, B, and C
as offered and depicted on Parcel Map, Subdivision MS 00 -0003, as follows to: Manuel
and Elba Gomez for Parcel A at 11 Grand Royale Court, Alamo (APN 192- 210 -028),
Drew and Heather Bennett for of Parcel B at 21 Grand Royale Court, Alamo (APN 192-
210 -029), and Adrian and Vanessa Kayari for Parcel C at 31 Grand Royale Court,
Alamo (APN 192 - 210 -030); and (2) authorizing staff to record documents with the
Contra Costa County Recorder.

BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District
(District) as follows:
THAT the District was offered a dedication (parcel map offers) for sanitary sewer easements
across Parcels A, B, C of Subdivision, known as MS 00 -0003 (Parcel Map), which was
recorded October 4, 2004 in Book 185 of Parcel Maps, at Pages 13 and 14, Contra Costa
County Records (185 PM 13); and
THAT the sanitary sewers and subdivision improvements associated with the Parcel Map
were not constructed and the District did not accept the parcel map offers; and
THAT the parcel map offers are now obsolete as the current Developer, Ony Homes, LLC, a
California limited liability company, is constructing a new sewer alignment that is different
than the previous sewer plan from 2004; and
THAT the Developer is selling Parcels A, B, and C of the Parcel Map; and
District hereby consents to execution of three quitclaim deeds to the following as listed in
Exhibit "A" hereto; and
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said documents for and on behalf of the District; and
THAT staff is authorized to record the documents in the office of the Recorder of Contra
Costa County.
