Petit — Director of Engineering &Technical Services Counsel for the District General Manager ISSUE: A resolution of the Board of Directors is required to accept deeds, grants, or offers of dedication to convey any real estate interest to the District and to record the documents with the Contra Costa County Recorder. RECOMMENDATION: Adopt a resolution accepting an offer of dedication and a grant of easement and authorizing staff to record the document with the Contra Costa County Recorder. FINANCIAL IMPACTS: The offer of dedication and the grant of easement were acquired at no cost to the District. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: At the southeast corner of Camino Tassajara and Tassajara Lane in the town of Danville, Ryder Homes (DBA Ryder Tassajara, LLC) planned and constructed a seven lot, single family, residential development as part of Subdivision 9287 (APN 215- 440 -009). ADOPT A RESOLUTION ACCEPTING AN OFFER OF DEDICATION AND GRANT OF EASEMENT FROM RYDER TASSAJARA, LLC RELATED TO TASSAJARA LANE, DANVILLE, SUBDIVISION 9287, JOB 6532, AND AUTHORIZING THE RECORDING language that is four full paragraphs. However, the final map was recorded without modifying the sanitary sewer easement offer. Not only does this language not comply with District standards, the limited offer does not expressly: grant the District permission to cross the remaining portion of land to access the easement; restrict specifically named encroachments (e.g., garages, swimming pools, tennis courts, etc.); mention not to cover manholes; nor limits the District's liability prior to the District accepting offers of easements. The Board of Directors regularly accepts offer of dedications and grants of easements by resolution. The recommended resolution will accept the offer for sanitary sewer easement as depicted on filed Subdivision Map 9287 that was required for Job 6532. Since said map did not have District's standard offer language, the resolution shall also accept the grant of easement for Parcels 1 & 1A for said job. Upon acceptance and recording of this resolution and grant of easement, the District will have the necessary easements as required for construction and acceptance of the public sewer main for said Job 6532. Board action is needed to accept the new permanent easement from the property owner named above. RECOMMENDED BOARD ACTION: Adopt a resolution: (1) Accept offer of sanitary sewer easements as depicted on filed final map Subdivision 9287 via Series Number 13- 198620, (2) Accept grant of easement related to Parcels 1 & 1A (Job 6532) from the property owner of the parcel listed in the attached proposed resolution; and (3) authorize staff to record the documents with the Contra Costa County Recorder. Proposed Resolution and Exhibit A C:\ Users \danderson\AppData \Local \Microsoft \Windows \Temporary Internet Files\Content.Outlook \IM9F5ZMU \Final PP GOE Tassajara Lane Job 6532 9- 3- 15.docx Page 2 of 2 ATTACHMENT 1 RESOLUTION NO. 2015 -03/ A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING AND RECORDING OFFER OF DEDICATION FROM RYDER TASSAJARA, LLC AND ACCEPTING AND RECORDING A GRANT OF EASEMENT RELATED TO SAID OFFER ON TASSAJARA LANE, DANVILLE SUBDIVISION 9287 (JOB 6532), AND AUTHORIZING THE RECORDING BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (District) as follows: THAT the District hereby accepts an offer of dedication for easements lying within the town of Danville within Contra Costa County shown on the final map of Subdivision 9287 (Job 6532), filed August 9, 2013 as Series 13- 198620 of Official Records of said County, State of California, said offer having originally been made by Ryder Tassajara, LLC, the owner of record of the property underlying said easement at the time said map was filed; THAT the District hereby accepts a Grant of Easement (Sewer Purposes) from said property owner for Parcels 1 & 1A (Job 6532), See Exhibit A; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said documents for and on behalf of the District; and THAT staff is authorized to record the documents in the office of the Recorder of Contra Costa County.
