Subject. DIRECT STAFF TO SECURE THE SERVICES OF AN ARBITRATOR IN
ACCORDANCE WITH THE DISTRICT'S STEP FOUR GRIEVANCE
PROCEDURE

ISSUE: When a grievance has been appealed to the Board, the Board must employ a
neutral third party to hear the matter and recommend action to the Board in accordance
with the Memorandum of Understanding (MOU) between the District and Public
Employees' Union Local One, Article III, Section 2.5.
RECOMMENDATION: Direct staff to secure the services of an arbitrator in accordance
with the District's grievance procedures.
FINANCIAL IMPACTS: The District and the Union share the cost of the arbitrator and
court reporter in the grievance process. An estimated cost of these services is $3,000 per
day, or $1,500 per party.
ALTERNATIVES / CONSIDERATIONS: None.
BACKGROUND: Construction Equipment Operator Mike Klubben has filed a grievance
against the District over his termination.
General Manager Roger Bailey appointed Director of Administration, David Heath, to be the
step three hearing officer in this case. Mr. Heath held the hearing on May 7, 2015 and
allowed the parties to present information and documentation in this matter. After careful
consideration, Mr. Heath denied the grievance. The Union has filed a step four grievance
on Mr. Klubben's behalf.

in accordance with the District's step four grievance procedures.
