Bailey General Manager ISSUE: Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and provides that an Order of the Board of Directors of the District to the effect that the ordinance has been published shall constitute conclusive evidence that publication has been properly made. RECOMMENDATION: Confirm the publication of the summaries of the following uncodified District Ordinances: • No. 285, adopting a schedule of Sewer Service Charge rates. • No. 286, adopting a schedule of Recycled Water Charges. • No. 287, adopting an updated schedule of Environmental and Development Rates and Charges. • No. 288, adopting an updated schedule of Capacity Fees, Rates and Charges. FINANCIAL IMPACTS: None. ALTERNATIVES /CONSIDERATIONS: Establishes presumption that the ordinance was correctly published and therefore would be deemed procedurally valid by a court. BACKGROUND: Summaries of District Ordinance Nos. 285, 286, 287 and 288, which were adopted by the Board at its meeting on June 4, 2015, were published in the Contra Costa Times and the San Ramon Valley Times on June 22, 2015. Ordinance No. 285 (uncodified) increases the annual single family Sewer Service Charge rate by $32 per residen- tial unit each year for the next two fiscal years. This will raise the single family residential an- nual charge to $471 for Fiscal Year (FY) 2015 -16 and to 5503 for FY 2016 -17. Similarly, the multi- family residential charge for apartments, corxiominiums, duplexes, second living units, or mobile homes will increase $24 each year for the next two fiscal years. This will raise the multi -family rate to $463 per unit for FY 2015 -16 and $487 for FY 2016.17. Non- residen- tial sewer service charge rates will be as de- termined by the Wastewater Cost of Service Study dated Mayy 21. 2015 prepared by Raftelis Finanaal ConsWtants, Inc.
