ISSUE: Board of Directors' authorization is required for the General Manager to
execute professional engineering service contracts for amounts greater than $100,000
or agreement revisions above 15% of the original agreement total.
RECOMMENDATION: Authorize the General Manager to execute an agreement with
Anchor Engineering (Anchor) and amend agreements with Harvest Technical Services,
Inc. (Harvest) and JN Engineering (JNE) to provide construction inspectors on an
as- needed basis for up to two years.
FINANCIAL IMPACTS: The total estimated cost for the inspection services is
$500,000. These costs will be paid for under the Fiscal Year (FY) 2015 -16 Capital
Improvement Budget (CIB) and Plan, and extend into FY 2016 -17.
ALTERNATIVES /CONSIDERATIONS: The District could add full -time positions or
request that staff perform the work, which is not recommended since the inspection
work required is seasonal.
BACKGROUND: Several construction projects have been or will soon be presented to
the Board for award in the Collection System and Treatment Plant Programs. Capital
Projects staff provides construction management, resident engineering, and inspection
duties for District projects, and supplements with consultant inspectors on an as- needed
basis. An evaluation of the construction work projected in FY 2015 -16 and FY 2016 -17
indicates that hiring up to four additional inspectors may be necessary during the
seasonal peak summer months.
On April 23, 2015, a Request for Proposals (RFP) was publicly advertised on the
District's website and PlanetBids, a service the District uses to advertise electronically.
Ten firms responded with qualified and responsive proposals. Pricing ranged from a low

of $73 /hour to a high of $165 /hour. After evaluating the proposals based on
qualifications, rates, and proximity to the District, staff selected Harvest, JNE, and
Anchor. As of April 1, 2015, the State of California Department of Industrial Relations
(DIR) has required Contractors or firms conducting prevailing wage work to register with
the DIR for all public works projects. JNE, Harvest, and Anchor are registered, and
Staff is recommending authorizing or amending contracts with these firms.
On April 17, 2014, the Board authorized the General Manager to execute an agreement
with JNE and Harvest for $100,000 each. These agreements will be amended to include
the services and rates provided under the RFP. Therefore, the JNE agreement will be
amended to include an additional $250,000, resulting in a total contract amount not to
exceed $350,000 (standard hourly rate of $73 /hour). JNE is scheduled to be the
inspection service used under the Collection System Program. The Harvest agreement
will be amended to include an additional $150,000, resulting in a total contract amount
not to exceed $250,000 (standard hourly rate ranging from $81 to $95 /hour). Harvest is
scheduled to be the inspection service used under the Treatment Plant Program.
Staff is also recommending a contract amount not to exceed $100,000 ($135 /hour) with
Anchor to provide as- needed inspection for the Collection System and Treatment Plant
Programs. Anchor provides specialty inspection for electrical, instrumentation, and
controls that are not covered under the other consultant agreements or staff.
The types of inspection services included in the JNE and Harvest agreements includes
general inspection duties on an as- needed basis, full time for projects, and urgent or
emergency construction inspection. The Anchor agreement provides similar inspection
duties; however, it also includes specialty inspection, as mentioned above. The cost for
these services will be paid directly by the capital improvement projects, and a separate
budget is not requested at this time. Staff has estimated up to 6,000 hours of time, plus
miscellaneous charges (mileage, reproduction, etc.), for construction inspection for the
M1 CIPP Rehabilitation Project; Lafayette Sewer Renovations, Phases 9 and 10;
Martinez Sewer Renovations, Phase 4; North Orinda Sewer Renovations, Phase 6;
Treatment Plant Safety Enhancements, Phase 4 Revised; Treatment Plant Piping
Renovations, Phase 8; and other District projects identified in the FY 2015 -16 CIB.
These agreements may also be used to support the recycled water and general
improvement programs.
COMMITTEE RECOMMENDATION: The Engineering and Operations Committee
reviewed this subject at its meeting on June 9, 2015, and recommended approval of the
JNE and Harvest agreement revisions. However, the Committee had a split
recommendation on the Anchor agreement.

RECOMMENDED BOARD ACTION:
Authorize the General Manager to execute a professional service agreement
revision with JN Engineering (Agreement No. 041703) in an amount not to
exceed $250,000 and with Harvest Technical Services (Agreement No. 042302)
in an amount not to exceed $150,000 to provide construction inspection services
for the District's capital improvement projects.
2. Authorize the General Manager to execute a professional service agreement with
Anchor Engineering in an amount not to exceed $100,000 to provide construction
inspection services for the District's capital improvement projects.
