Bailey General Manager JM Petit — Director of Engineering and Technical Services ISSUE: Board of Directors' authorization is required for the General Manager to execute professional engineering service contracts for amounts greater than $100,000 or revising an existing agreement above 15% of the total agreement amount. RECOMMENDATION: Authorize the General Manager to execute an agreement with Anchor Engineering (Anchor) and amend agreements with Harvest Technical Services, Inc. (Harvest) and JN Engineering (JNE) to provide construction inspectors on an as- needed basis for up to two years. FINANCIAL IMPACTS: The total estimated cost for the inspection services is $500,000. These costs will be paid for under the Fiscal Year (FY) 2015 -16 Capital Improvement Budget (CIB) and Plan, and extend into FY 2016 -17. ALTERNATIVES /CONSIDERATIONS: The District could add full -time positions or request that staff perform the work, which is not recommended since the inspection work required is seasonal. BACKGROUND: Several construction projects have been or will soon be presented to the Board for award in the Collection System and Treatment Plant programs. Capital Projects staff provides construction management, resident engineering, and inspection duties for District projects, and supplements with consultant inspectors on an as- needed basis. An evaluation of the construction work projected in 2015 -16 and 2016 -17 indicates that hiring up to four additional inspectors may be necessary during the seasonal peak summer months. On April 23, 2015, a Request for Proposals (RFP) was publicly advertised on the District's website and PlanetBids, a service the District uses to advertise electronically. Ten firms responded with qualified and responsive proposals. Pricing ranged from a low of $73 /hour to a high of $165 /hour. AND JN ENGINEERING TO PROVIDE AS- NEEDED CONSTRUCTION INSPECTORS FOR CAPITAL IMPROVEMENT PROJECTS qualifications, rates, and proximity to the District, staff selected Harvest, JNE, and Anchor Engineering. Staff is recommending authorizing or amending contracts with these firms. On April 17, 2014, the Board authorized the General Manager to execute an agreement with JNE and Harvest for $100,000 each. These agreements will be amended to include the services and rates provided under the RFP. Therefore, the JNE agreement will be amended to include an additional $250,000, resulting in a total contract amount not to exceed $350,000 (standard hourly rate of $73 /hour). JNE is scheduled to be the primary inspection service for the Collection System Program. The Harvest agreement will be amended to include an additional $150,000, resulting in a total contract amount not to exceed $250,000 (standard hourly rate from $81 to $95 /hour). Harvest is scheduled to be the primary inspection service for the Treatment Plant Program. Staff has negotiated an hourly rate of $135 with Anchor Engineering and is recommending a contract amount not to exceed $100,000 to provide as- needed inspection for the Collection System and Treatment Plant Programs. The types of inspection services included in these contracts are as- needed relief inspection, full -time inspection for projects, and urgent and emergency construction inspection. The cost for the services will be paid directly by the capital improvement projects, and no separate budget is requested at this time. Staff has estimated up to 6,000 hours of time, plus miscellaneous charges (travel, reproduction, etc.), for construction inspectors for the M1 CIPP Rehabilitation Project; Lafayette Sewer Renovations, Phases 9 and 10; Martinez Sewer Renovations, Phase 4; North Orinda Sewer Renovations, Phase 6; Treatment Plant Safety Enhancements, Phase 4 Revised; Treatment Plant Piping Renovations, Phase 8; and other District projects identified in the FY 2015 -16 CIB. COMMITTEE RECOMMENDATION: The Engineering and Operations Committee reviewed this subject at its meeting on June 10, 2015, and recommended .... RECOMMENDED BOARD ACTION: Authorize the General Manager to execute a professional engineering service agreement with the following listed consultants and amounts to provide construction inspection services for the District's capital improvement projects up to two years: • Amend the Harvest Technical Services Agreement No. 042302 in an amount not to exceed $150,000; • Amend the JN Engineering Agreement No. 041703 in an amount not to exceed $250,000; • Execute an agreement with Anchor Engineering in an amount not to exceed $100,000.
