ISSUE: When Lunada Lane in Alamo was relocated in 1978, Contra Costa County
quitclaimed the right of way but reserved utility rights for affected utilities. While the
District has no facilities at that location, the owner has requested that the District
quitclaim its obsolete rights on the property.
RECOMMENDATION: Approve a quitclaim deed to Albert R. Rubey, Trustee of the
Albert R. Rubey Trust; authorize the President of the Board and the Secretary of the
District to execute the quitclaim deed; and authorize staff to record the documents with
the Contra Costa County Recorder.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The relocation of Lunada Lane in 1978 resulted in the County
quitclaiming the old right of way to the owner of 3189 Danville Boulevard and reserving
utility rights for affected utilities. The owner is now developing the parcel, and the title
company has required that the owner secure quitclaims from the utilities for the old right
of way. The District has no facilities on the parcel.
RECOMMENDED BOARD ACTION: Adopt the proposed resolution approving a
quitclaim deed for the property located at 3189 Danville Blvd, Alamo (APN 191 -093-
048); authorize the President of the Board and the Secretary of the District to execute
the deed; and authorize staff to record the documents with the Contra Costa County
Recorder.

A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT
AUTHORIZING EXECUTION AND RECORDING OF A QUITCLAIM DEED TO
ALBERT R. RUBEY, TRUSTEE OF THE ALBERT R. RUBEY TRUST, PROPERTY OWNER
3189 DANVILLE BOULEVARD, ALAMO (APN 191 - 093 -048)
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District
(District) as follows:
THAT the District hereby consents to the execution of a Quitclaim Deed — Easement, dated
June 4, 2015, to Albert R. Rubey, Trustee of the Albert R. Rubey Trust, property owner of
3189 Danville Boulevard in Alamo (APN 191 - 093 -048); and
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said deed for and on behalf of the District; and
THAT staff is authorized to record said deed in the office of the Recorder of Contra Costa
County.
