Bail y g 9 General Manager ISSUE: The District Code and state law require that the Board conduct a public hearing prior to considering placement of Capacity Use Charges and assessments for Contractual Assessment Districts (CADs), Alhambra Valley Assessment District (AVADs), and other fee installment payment programs on the County tax roll. RECOMMENDATION: Set a public hearing for July 23, 2015 to receive comment on placing the Fiscal Year 2015 -16 Capacity Use Charges and assessments for CADs, AVADs, and other fee installment payment programs on the County tax roll for collection. FINANCIAL IMPACTS: None by this action, however, the staff recommendation to place assessments and charges on the County tax roll is the most efficient and cost - effective method of collection. The alternative, direct billing of these charges, would incur additional staff time and could result in a lower rate of collection. ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the recommended public hearing date or may elect to choose a different date. However, a public hearing must be held if assessments and charges are to be placed on the County tax roll for collection. BACKGROUND: Commercial tenants and commercial property owners may elect to participate in the District's Capacity Use Charge program for payment of Capacity Use Charges over a fifteen -year period in lieu of capacity fees. Property owners who have formed CADs have agreed to pay for sewer improvements over a ten -year period. Payments are to be collected by placing assessments on each property owner's annual property tax bill. Property owners who are converting their properties from septic tank to sanitary sewer, and AVAD non - participants who are connecting their properties may elect to participate in the District's fee installment payment programs. The Board must conduct a public hearing prior to considering placement of charges and assessments on the Contra Costa County property tax roll for collection. RECOMMENDED BOARD ACTION: Set a public hearing for July 23, 2015 at 2:00 p.m. to receive comment on placing Fiscal Year 2015 -16 Capacity Use Charges and assessments for CADs, AVADs, and other fee installment payment programs on the Contra Costa County tax roll for collection.
