ISSUE: The District Code and State law require that a public hearing be held to receive
public comment on placing the Sewer Service Charges (SSCs) on the Contra Costa
County tax roll for collection.
RECOMMENDATION: Authorize a public notice to set a public hearing on July 23,
2015 at 2:00 p.m. to receive public comment on placing the SSCs on the County tax roll
for collection.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: The Board could not hold the public hearing
and could opt to direct bill its customers; however, staff does not recommend this
alternative, given that it is more economical to place the collection on the tax roll, which
the District has done since the inception of the SSC in 1976, as authorized by Section
5473 of the California Health & Safety Code.
BACKGROUND: District Code 6.24.150 and Health & Safety Code section 5473.1
require the holding of a public hearing to consider the report identifying the properties
and their associated charges that will be transmitted to the County for collection on the
tax roll. In past years, the Board authorized collection of the SSCs on the tax roll at the
same public hearing at which the SSC rates were established.
At the public hearing, the Board will hear any objections or protests to the report, and if
a majority of property owners object to collection on the tax roll, then the charges must
be billed directly and not placed on the tax roll. At the conclusion of the hearing, the
Board may adopt, revise, change, reduce or modify any charge or overrule any or all
objections to the report.

Legal notices will be published in the Contra Costa Times and the San Ramon Valley
Times for the July 23, 2015 public hearing, and the Notice of Public Hearing will be
posted on the District's website.
COMMITTEE RECOMMENDATION: No Committee review is necessary for this action.
RECOMMENDED BOARD ACTION: Set July 23, 2015 at 2:00 p.m. as the date and
time for a public hearing to receive public comment on placing the FY 2015 -16 SSCs on
the Contra Costa County tax roll for collection.
