Petit — Director of Engineering & Technical Services Counsel for the District General Manager ISSUE: A resolution of the Board of Directors is required to execute the real property agreement and to record the document. RECOMMENDATION: Adopt a resolution authorizing the execution of a real property agreement, and authorizing staff to record the documents with the Contra Costa County Recorder. FINANCIAL IMPACTS: None. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: Contra Costa County is installing a carport structure in the County's Public Works Department parking lot. Solar panels will be mounted on top of the carport structures as part of the County's Renewable Energy Program. A small portion of one of the proposed solar panels structure, approximately 72 square feet, will aerially encroach into the District's easement in a triangular shape, with a hypotenuse of approximately 17 feet, that protrudes approximately 8.5 feet into the District's 10 -feet- wide easement, and with a minimum clearance of 12 feet above the asphalt paving to the bottom of the lowest portion of the array. Staff requested that the County enter into a real property agreement to abate the encroachment. Board action is required to enter into the real property agreement. RECOMMENDED BOARD ACTION: Adopt a resolution: (1) authorizing the execution of a real property agreement with Contra Costa County related to 255 Glacier Drive, Martinez; and (2) authorizing staff to record the document with the Contra Costa County Recorder.
