ISSUE: Prior to entering into any lease of real property owned by the District for a term
not to exceed 10 years, the Board must conduct a public hearing. The subject property
must be used for compatible uses and for public benefit, and the leased property also
must be declared unneeded for District purposes during the term of the lease.
RECOMMENDATION: Adopt a resolution authorizing the General Manager, or his
designee, to lease portions of the parcel located at 4737 Imhoff Place, Martinez
(APN 159 - 150 -057), for a term not to exceed 10 years; and declare the property as
unneeded for District purposes during the terms of the leases.
FINANCIAL IMPACTS: The District will receive additional rental income. The actual
amount will depend on the individual lease and agreement terms.
ALTERNATIVES /CONSIDERATIONS: The alternative to this action is to abandon
lease income.
BACKGROUND: The District currently issues various short-term leases, not exceeding
10 years, on warehouse spaces (bays) located on the property at 4737 Imhoff Place,
Martinez. This property is located directly west of the District Headquarters Office
Building. The 4737 Imhoff Place building is a warehouse structure consisting of 11
bays. The District historically has utilized some of the warehouse spaces for its own
needs, which vary from time to time, and leased the unneeded warehouse spaces to
obtain revenue for the District.
Nearly 10 years ago, the Board adopted Resolution 2005 -052 which authorized the
General Manager, or his designee, to negotiate, execute and administer leases for the
warehouse spaces. The authority to lease the unneeded warehouse spaces will cease
in June 2015 and staff is requesting a similar resolution be adopted to facilitate leasing
the unneeded warehouse spaces over the next 10 -year period.

COMMITTEE RECOMMENDATION: The Real Estate, Environmental & Planning
Committee reviewed this matter at the December 9, 2014 meeting and recommended
approval.
RECOMMENDED BOARD ACTION: Adopt a resolution authorizing the General

RESOLUTION NO. 2015 -
A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY
DISTRICT AUTHORIZING THE GENERAL MANAGER TO EXECUTE
LEASE AGREEMENTS FOR PORTIONS OF 4737 IMHOFF PLACE (APN
159 - 150 -057) FOR A PERIOD NOT TO EXCEED 10 YEARS, AND
DECLARE THE PROPERTY AS UNNEEDED FOR THE TERM OF THE
LEASE AGREEMENTS
WHEREAS, the Central Contra Costa Sanitary District (District) owns approximately
one and a half (1.5) acres at 4737 Imhoff Place, just west of the Martinez Treatment
Plant (Property); and
WHEREAS, the Property is more specifically identified as a portion of APN 159 -150-
057; and
WHEREAS, this parcel features a preexisting, permitted warehouse structure with 11
loading bays that has been used for many years for commercial and light industrial
uses, storage and loading and unloading uses, in conformity with the local zoning code
and land use regulations; and
WHEREAS, the District historically has utilized portions of the Property in accordance
with its needs, which use varies from time to time, and leased the unneeded portions of
the Property to obtain revenue for the District; and
WHEREAS, the Board of Directors held a noticed public hearing on January 8, 2014, to
determine whether the proposed lease of the Property would be compatible with District
activities and functions, and would provide a public benefit; and
WHEREAS, the District seeks to continue to allow the use of the warehouse facility by
outside parties, which could be done without modification or with only minor alterations
to the land.
THEREFORE, BE IT RESOLVED by the Board of Directors of the District as follows:
1. That, after holding a noticed public hearing, the Board of Directors finds that the
Property is currently unneeded for the performance of the District's purposes,
functions, and duties. Furthermore, the Board of Directors finds that the
proposed lease for the Property is compatible with the District's activities and
functions.
2. That, after holding a noticed public hearing, the Board of Directors finds that the
lease of the Property would provide a public benefit by generating funds for the
District's duties and functions.

3. That the General Manager, or his designee, is authorized to execute lease
agreements for the vacant bays at the warehouse for a term not to exceed 10
years. Such leases shall be made at competitive market rates to private parties
which have uses compatible with the activities, duties, and functions of the
District.
4. That the proposed lease is exempt from the California Environmental Quality Act
(CEQA) under District CEQA Guidelines Section 15301, since it involves leasing
an existing public facility of use.
5. That each portion of this resolution is severable. Should any portion of this
resolution be adjudged to be invalid and unenforceable by a body of competent
jurisdiction, then the remaining resolution portions shall be and continue in full
force and effect.
6. That staff is authorized to record the documents in the office of the Recorder of
Contra Costa County.
