SUBJECT: BOARD - APPROVED LEAVE OF ABSENCES
As discussed during the September 18, 2014 Board meeting, the Board of Directors
directed staff to bring this issue to the Administration Committee for further discussion
and direction.
Pursuant to the Memoranda of Understanding (MOUs) between the District and the
Management Group, Management Support/Confidential Group, and Local 1, any leave
of absence without pay in excess of thirty days requires Board approval.
Other than the provisions in the MOUs, there is no legal regulation that requires that a
leave of absence be approved by the governing body of an employer.
Staff is recommending that leave requests no longer require Board approval, only
Department/General Manager approval, for several reasons. It is administratively
expeditious, allows for greater privacy for all District employees by not listing the item on
the public agenda for a Board meeting, and, in many cases, the Board truly does not
have an alternative to denying a request as it may be unlawful.
Should the Committee adopt staff's recommendation, staff will meet and confer with the
bargaining units. Once agreement has been reached between the District and the
bargaining units, a position paper requesting a revision of the applicable provisions of
the MOU will be brought to the full Board for approval.
Staff will be available to answer any questions or provide clarification during the
meeting.
