Bailey Counsel for the Dis ict General Manager ISSUE: Wastewater Discharge Permit Contracts for Class I Industrial Users must be approved by the Board of Directors. The current Permit Contract with Acme Fill Corporation (Acme) will expire on October 31, 2014. An extension is needed for Acme to continue discharging treated landfill leachate under the current Permit Contract after November 1, 2014. RECOMMENDATION: Authorize the General Manager to execute an extension of up to three months for the current Permit Contract with Acme Fill Corporation regarding the acceptance of treated landfill leachate. FINANCIAL IMPACTS: No adverse financial impacts are anticipated from processing this extension. Environmental Compliance, Laboratory, and legal costs are recovered by direct billing. Treatment plant and collection system costs are recovered through the Sewer Service Charge. ALTERNATIVES /CONSIDERATIONS: The alternative to the proposed extension to the Permit Contract would be to process a new three year contract with no modifications. This alternative is not recommended since some alteration of the monitoring and pretreatment processes may be appropriate while still protecting District operations; therefore, staff feels it is appropriate to complete the modifications to the Permit Contract. BACKGROUND: Acme's pretreated landfill leachate has been accepted by the District under a pilot project since the early 1990's, and through permit contracts since 1994. A permit contract was used to protect the District and to preserve the right to modify the discharge conditions or stop receiving the treated leachate. Staff planned on presenting the Permit Contract authorizing Acme to continue discharging after November 1, 2014 for Board of Directors' approval at the October 16 Page 1 of 2 POSITION PAPER Board Meeting Date: October 2, 2014 Subject: AUTHORIZE THE GENERAL MANAGER TO EXECUTE AN EXTENSION UP TO THREE MONTHS TO THE PERMIT CONTRACT WITH ACME FILL CORPORATION FOR DISCHARGE OF TREATED LANDFILL LEACHATE meeting, which was subsequently cancelled. An extension up to three months will allow negotiations with Acme to continue and allow time to request Board of Directors' approval on new Permit Contract terms. COMMITTEE RECOMMENDATION: The Real Estate, Environmental & Planning Committee is scheduled to review proposed renewal of the Permit Contract with Acme Fill Corporation when it meets on October 7, 2014. RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an extension of up to three months for the current Permit Contract with Acme Fill Corporation regarding the acceptance of treated landfill leachate from the Acme Landfill located in Martinez, California.
