MEMORANDUM FOR: THE HONORABLE MEMBERS OF THE BOARD OF DIRECTORS

SUBJECT: EXECUTE AGREEMENT RELATING TO REAL PROPERTY WITH ALLAN
DE FRAGA, ET UX AND JAMES J. STEINER, ET UX, JOB 1824,
PARCELS 1 & 2, LOCATED ON SOUTH SIDE OF "F" STREET AND
WEST OF GENEVA STREET, MARTINEZ
ISSUE: The DeFraga's house was constructed many years ago over an existing
4 -inch sewer line which was inherited from the City of Martinez as a public
sewer main. The property owners desire to maintain the house in its
present location.
BACKGROUND: The 4 -inch sewer line is a substandard main line and was
installed without an easement.
The property owners have granted this District an easement for the 4 -inch
"main line", which will permit the District to maintain this line in its
present location. They have also granted a replacement easement which
gives this District the right to install a new 8 -inch sewer main to the
west of the above-mentioned house if this becomes necessary.
RECOMMENDATION: Approval to execute the "Agreement" and authorize its
recording.

SUBJECT: THE CONSIDERATION OF A "PRELIMINARY ENVIRONMENTAL ASSESSMENT" FOR
DSP 3170, OUTFALL REPAIR, 1979
ISSUE: It is necessary to consider the environmental effects of DSP 3170
BACKGROUND: Work is currently in process for the design of the repair of
the outfall. The Environmental Assessment is required by our Ordinance 95
implementing the California Environmental Quality Act.
RECOMMENDATION: Find the project to be categorically exempt (emergency) and
direct staff to file Notice of Exemption.

SUBJECT: CONSENT TO COMMON USE OF EXISTING COUNTY STORM DRAINAGE
AND SLOPE EASEMENTS WITH C.C.C.S.D. FOR USE AS A SEWER
EASEMENT (JOB 3148 - PARCEL 1) SAN RAMON AREA. (NO COST
TO THE DISTRICT).
ISSUE: The sewer easement required to serve Subdivision 5467 must be
located within the above -mentioned County easements.
BACKGROUND: This District and the County have executed similar documents
in the past.
The County will retain their prior rights in the easement area, while
permitting the installation and maintenance of our sewer facilities.
The "Consent" provides protection to both parties from damages caused by
the actions of the other party.
RECOMMENDATION: Approval. Execute document and authorize its recording.

SUBJECT: AUTHORIZATION FOR $50 FOR ATTENDANCE OF WENDLE WHIPPLE AT A LEGAL
SEMINAR FOR SURVEYORS IN SOUTH SAN FRANCISCO ON JUNE 2, 1979
ISSUE: It is necessary for personnel at the District to keep current on
the law as it pertains to real property.
BACKGROUND: The above -referenced seminar will cover subjects relating
to title to properties, changes in ownership and rights created through
the granting of easements. All of these subjects, especially easement
rights, are pertinent to weekly activities at the District. The seminar
provides a good opportunity for lay people to get current information on
legal requirements.
RECOMMENDATION: Authorize $50 for attendance of Wendle Whipple at a
legal seminar for Surveyors in South San Francisco on June 2, 1979.
