STEPHEN WISE, 125 FAIRFIELD PLACE, MORAGA IN THE AMOUNT OF $75,000.00 PROPERTY DAMAGE ISSUE: This claimant is the neighbor of the DeJarnett's, 119 Fairfield Place who have also filed a claim for damages. BACKGROUND: This is a slide area that was repaired by the former owners of the properties with the financial participation of the District. Both owners guaranteed the work. I don't feel that there is any real basis for this claim because the repair work has not damaged the Wise property. RECOMMENDATION: Deny claim and refer to insurance carrier. Dolan, General Manager -Chief Engineer SUBJECT: REQUEST AUTHORIZATION TO CLOSE ACCOUNT 2910 "DEER TRAIL SEWER RELOCATION" AND RETURN $1,2b1.00 SURPLUS TO APPROPRIATE ACCOUNT ISSUE: $5,000.00 was authorized by the Board for this work. The job has been completed and there is a surplus of $1,261.00 in the authori- zation that can be returned to the appropriate account. BACKGROUND: A pier for a retaining wall was driven through the 6" sewer line on Deer Trail. To correct the problem it was necessary to relocate the line away from the slide area the wall is containing. Dolan, General Manager -Chief Engineer SUBJECT: Authorize the attached quote for a cost audit of the District garbage franchises. ISSUE: An audit is required to justify the costs reported by the garbage franchises in their 1977 financial statements and 1978 -79 rate request. BACKGROUND: The garbage companies franchised by the District are currently preparing requests for increased rates for 1978 -79. In the past, a study has been performed by the District staff to justify reported costs. However, because of the personnel shortage we are currently experiencing in our accounting office, a study by the District staff will take more time than is available. Therefore, it is recommended that the District authorize Mr. Sandy Plourde, our CPA on retainer, to perform the cost study. Mr. Plourdes time schedule and financial quotation is attached. Dolan General Manager -Chief Engineer SUBJECT: NE14 OFFICE BUILDING I. SITES There were a total of 27 building sites submitted for consideration (Exhibit A). We have selected eight for further evaluation. The final recommendation to the Board should be ready by the end of April after the architect has a chance to review the sites. 2. SELECTION OF ARCHITECT We have received a total of 46 submittals from architects and we have screened these submittals down to eight (Exhibit B 45- minute interviews for architects for Friday, �' We have scheduled to 5:15 p.m. The scope of the interview is coverediin7therattacheda'm. letter we propose to send to the architects (Exhibit C). 3. BUILDING EXTERIOR DESIGN This is the appropriate time to consolidate our ideas on what the building will look like. To help us in our consideration of a desired design, pictures of existing, local buildings have been placed on the display board. See Exhibit D for partial list. Please indicate your preference as to exterior design. Dolan, General Manager -Chief Engineer SUBJECT: EXECUTE "CONSENT TO COMMON USE" WITH P.G. &E. FOR CROSSING EXISTING 100' IN WIDTH P.G. &E. EASEMENT NEAR DOLORES WAY IN ORINDA ISSUE: This "Consent to Common Use" is required to permit an 8 -inch sewer main to cross P.G. &E's prior existing easement. BACKGROUND: This agreement is the standard P.G. &E. Consent to Common Use form. It retains their prior rights while permitting us to cross their easement. It also provides that we can both use the common use area provided we do not unreasonably interfere with the rights of the other.
