ISSUE: Board approval is needed to execute a contract with Industrial Employers and Distributors Association (IEDA) to provide labor negotiation services for the District. RECOMMENDATION: Approve the contract with IEDA and authorize the Board resident to execute the contract effective October 2014 through January 2018. FINANCIAL IMPACTS: This action will result in an approximate cost of $90,000 for the term of the contract. ALTERNATIVES /CONSIDERATIONS: Do not approve the contract with IEDA. BACKGROUND: At the Board Workshop that took place in October 2013, the Board determined that it would be prudent to engage the services of a labor relations expert well before expiration of the District's Memoranda of Understanding (MOUs) in December 2017. The need to engage an expert now was based upon the desire of the Board to thoroughly vet and analyze items related to negotiations prior to the commencement of actual negotiations, which are anticipated to begin approximately six months prior to the expiration of the MOUs, in June 2017. As such, the Administration Committee selected three agencies that would be able to provide these services, and a representative of each agency presented a scope of work/fee schedule to the Committee. The Committee recommended that the Board approve a contract with IEDA for labor negotiation services effective October 2014 through January 2018. IEDA was founded in 1937 and is a non - profit agency that provides Human Resources services to over 150 private and public sector employers. APPROVE THE CONTRACT WITH INDUSTRIAL EMPLOYERS AND DISTRIBUTORS ASSOCIATION (IEDA) TO PROVIDE LABOR NEGOTIATION SERVICES AND AUTHORIZE THE BOARD PRESIDENT TO EXECUTE THE CONTRACT with negotiation representation (chief spokesperson role) and labor relations analysis as related to negotiations. Mr. Bruce Heid will act as the Chief Negotiator for the District, and the District will have access to a staff of negotiators and other in -house experts who specialize in providing a range of negotiation services. Additionally, IEDA staff possesses extensive knowledge of the local labor market as they have provided these services to many local public agencies including counties, cities, and special districts. Since IEDA is a non - profit agency, employers pay a single monthly fee that is based upon the number of employees and number of bargaining units. The monthly fee does not change regardless of the needs of the employer during the fee cycle. Effective July 1, 2014, the monthly all- inclusive fee for the District will be $3,365. However, since actual negotiations would not commence until approximately June of 2017, which is six months prior to the expiration of the MOUs, IEDA has offered to reduce the monthly premium by 50 percent for the strategic planning phase of negotiations. This reduction in fees would apply until actual negotiations begin. For illustrative purposes, if IEDA were to be retained by the District effective October 1, 2014 through contract ratification and adoption in January 2018, the estimated cost for the 2017 labor negotiations would be approximately $90,000. COMMITTEE RECOMMENDATION: This matter was discussed at the Administration Committee meeting on August 19, 2014 and the Committee recommended that the Board enter into a contract with IEDA. RECOMMENDED BOARD ACTION: Authorize the Board President to enter into a contract with IEDA to provide labor negotiation services for the District for the period October 2014 through January 2018 at an estimated cost of $90,000.
