ISSUE: Section 6490 of the Health and Safety Code of the State of California provides
that District ordinances shall be published once in a newspaper of general circulation
within the District, and provides that an Order of the Board of Directors of the District to
the effect that the ordinance has been published shall constitute conclusive evidence
that publication has been properly made.
RECOMMENDATION: Confirm the publication of summaries of District Ordinance
Nos. 280, 281, and 282.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: Establishes presumption that the ordinances
were correctly published and therefore would be deemed procedurally valid by a court.
BACKGROUND: Summaries of District Ordinance Nos. 280 and 281, which were
adopted by the Board at its meeting on June 5, 2014, were published in the Contra
Costa Times and the San Ramon Valley Times on June 16, 2014. Ordinance No. 280
adopted an updated Schedule of Environmental and Development - Related Rates and
Charges in accordance with District Code Chapter 6.30, and Ordinance No. 281
adopted an updated Schedule of Capacity Fees, Rates and Charges in accordance
with District Code Chapter 6.12.
A summary of Ordinance No. 282, which was adopted by the Board at its meeting on
June 19, 2014, was published in the Contra Costa Times and the San Ramon Valley
Times on June 27, 2014. Ordinance No. 282 established reimbursement fees for the
properties which could directly connect to Job 5773 (Smith Road Contractual
Assessment District (CAD) 2012 -1) in Alamo.

Ordinance No. 282 (Uncodified) establishes Re-
imbursement Fees of $20,755 for the 6th partici-
pant connector and $17,791 for the 7th partici-
pant connector to Job 5773 (Smith Road CAD
2012 -1) in Alamo, in accordance with District
Code Chapter 8.20 "Reimbursement €oes" and
the District's Contractual Assessment Distract
Program. The reimbursement fees set forth by
this ordinance shall be administered, adjusted,
and collected according to the provisions of

CONTRA COSTA SANITARY DISTRICT ADOPTING
AN UPDATED SCHEDULE OF CAPACITY FEES,
RATES AND CHARGES IN ACCORDANCE WITH
DISTRICT CODE CHAPTER 5.12
Ordinance No. 281 (uncodiffed) adopts an up-
dated Schedule of Capacity Fees,, Rates and
Charges" including an increase of the Gravity
Capacity Fees from $5,934 to $5.995 per Res[ -
dent al Unit Equivalent and a decrease of the
Pumping Capacity Fee from $1,58Tto $1,585 per
Residential Unit Equivalent. These changes re-
sult in a Gravity Zone Fee (Zone 1) of $5,995 per
Residential Unit Equivalent, and a Pumped Zone
Fee (Zone 2) of $7,580 per Residential Unit
