ISSUE: Board authorization is required for a medical leave of absence without pay in
excess of 30 days.
RECOMMENDATION: Authorize medical leave of absence without pay for Dulce
Petagara, Environmental Compliance Inspector I.
FINANCIAL IMPACTS: Currently, the District is only paying for Ms. Petagara's medical
and dental insurance, resulting in a monthly cost of $2,666.26.
ALTERNATIVES /CONSIDERATIONS: At this time, there are no other alternatives as
the District cannot lawfully terminate Ms. Petagara's medical leave of absence.
BACKGROUND: Ms. Petagara has been on an unpaid leave of absence since June
11, 2014. Ms. Petagara will exhaust the twelve weeks of leave protected by the Family
Medical Leave Act to which she is entitled on August 4, 2014. Her medical leave of
absence is anticipated to extend beyond the twelve weeks of protected Family Medical
Leave and she is anticipated to return to work on November 3, 2014.
Since this request exceeds the 30 working days that the General Manager and
Department Director may approve, Board of Directors' authorization is required.
COMMITTEE RECOMMENDATION: As this matter is considered routine and results in
a minimal financial impact, this matter was not reviewed by the Administration
Committee and it is being sent directly to the Board for authorization.
RECOMMENDED BOARD ACTION: Authorize medical leave of absence without pay
for Dulce Petagara, Environmental Compliance Inspector I, through November 6, 2014.
