Boehme Secretary of the District ISSUE: Board approval is required for any salary adjustment that exceeds the adjustment in the California Consumer Price Index (CPI) -Urban Wage Earners and Clerical Workers for any employees that are not represented by a union or recognized employee organization and considered a local agency executive. RECOMMENDATION: Approve a 2.4- percent salary adjustment, which exceeds the 1.9- percent California CPI, for General Manager Roger S. Bailey effective August 19, 2014. FINANCIAL IMPACTS: Upon approval, this action results in an annual cost of $5,496. ALTERNATIVES /CONSIDERATIONS: Deny the salary adjustment for Mr. Bailey. BACKGROUND: The employment contract between the District and Mr. Bailey states that "The Board annually will consider adjustment of the General Manager's annual salary in such amounts and to such extent as the Board may determine is desirable on the basis of its annual review and evaluation of the General Manager." The Board has concluded Mr. Bailey's annual review and determined that a salary adjustment is warranted based upon his performance. The Memoranda of Understanding (MOUs) between the District and all of its represented employees dictated a 2.4- percent increase, as reflected by the change in the Bay Area Region CPI. The Board has determined that the same salary increase shall be granted to Mr. Bailey effective August 19, 2014. However, pursuant to Government Code 3511.2, effective on or after January 1, 2012, any salary adjustment for those employees considered a local agency executive that exceeds the California CPI in any given year must be brought to the Board for approval during a regular Board meeting. The most recent change in the California CPI was 1.9 percent, which is lower than the Bay Area Region CPI adjustment recommended for Mr. Bailey. Therefore, this action is being brought to the Board for approval. RECOMMENDED BOARD ACTION: Approve a 2.4- percent salary adjustment, which exceeds the 1.9- percent California CPI, for General Manager Roger S. Bailey effective August 19, 2014.
