ESTABLISH JULY 31, 2014 AS THE DATE FOR A PUBLIC HEARING TO RECEIVE COMMENTS ON PLACING FISCAL YEAR 2014 -15 CAPACITY USE CHARGES AND ASSESSMENTS FOR CONTRACTUAL ASSESSMENT DISTRICTS, ALHAMBRA VALLEY ASSESSMENT DISTRICTS, AND OTHER FEE INSTALLMENT PAYMENT PROGRAMS ON THE COUNTY PROPERTY TAX ROLL FOR COLLECTION Submitted By. Petit — Engineering Department Director General Manager ISSUE: The District Code and state law require that the Board conduct a public hearing prior to considering placement of Capacity Use Charges and assessments for Contractual Assessment Districts (CADs), Alhambra Valley Assessment District (AVADs), and other fee installment payment programs on the County tax roll. RECOMMENDATION: Establish July 31, 2014 as the date for a public hearing to receive comments on placing the Fiscal Year 2014 -15 Capacity Use Charges and assessments for CADs; AVADs, and other fee installment payment programs on the County tax roll for collection. FINANCIAL IMPACTS: None by this action, however, the staff recommendation to place assessments and charges on the County tax roll is the most efficient and cost - effective method of collection. The alternative, direct billing of these charges, would incur additional staff time and could result in a lower rate of collection. ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the recommended public hearing date or may elect to choose a different date. However, a public hearing must be held if assessments and charges are to be placed on the County tax roll for collection. BACKGROUND: Commercial tenants and commercial property owners may elect to participate in the District's Capacity Use Charge Program for payment of Capacity Fees over a fifteen -year period. Property owners who have formed CADs have agreed to pay for sewer improvements over a ten -year period. Payments are to be collected by placing assessments on each property owner's annual property tax bill. Property owners who are converting their properties from septic tank to sanitary sewer, and AVAD non - participants who are connecting their properties may elect to participate in the District's fee installment payment programs. The Board must conduct a public hearing prior to considering placement of charges and assessments on the Contra Costa County property tax roll for collection. COMMITTEE RECOMMENDATION: This matter will be reviewed by the Finance Committee at their July 21, 2014 meeting. RECOMMENDED BOARD ACTION: Establish July 31, 2014 as the date for a public hearing to receive comments on placing Fiscal Year 2014 -15 Capacity Use Charges and assessments for CADs, AVADs, and other fee installment payment programs on the Contra Costa County tax roll for collection.
