Bailey Counsel for the Distr' t General Manager ISSUE: A Declaration of an Emergency by the Board is required for the General Manager to perform emergency repairs under Public Contract Code 22050(b). RECOMMENDATION: Declare an emergency and ratify the General Manager's actions under Public Contract Code 22050, and as authorized in General Manager authority Resolution 2011 -065, to direct W.C. Maloney, Inc., DN Tanks, and District forces to perform emergency repairs on the damaged Sludge Blending Tank (SBT) located in the Treatment Plant; and approve a supplemental authorization for $200,000 to the Treatment Plant Program contingency account of the Fiscal Year (FY) 2013 -14 Capital Improvement Budget (CIB). FINANCIAL IMPACTS: The cost of the repairs is estimated to be $140,000 to $200,000. There are insufficient funds in the contingency account of the Treatment Plant Program of the CIB for these repairs. A supplemental authorization for $200,000 to the Treatment Plant Program contingency account of the FY 2013 -14 Capital Improvement Budget is required. ALTERNATIVES /CONSIDERATIONS: Perform repairs under non - emergency procedures using a traditional bid process, which is not recommended. The damaged SBT poses a significant safety issue to personnel and essential equipment below the damaged area. BACKGROUND: The District uses the SBT for mixing and pH control of the thickened secondary and primary sludges prior to centrifuge dewatering. MALONEY, INC., DN TANKS, AND DISTRICT FORCES TO PERFORM EMERGENCY REPAIRS ON THE DAMAGED SLUDGE BLENDING TANK (SBT); AND APPROVE A SUPPLEMENTAL AUTHORIZATION FOR $200,000 TO THE TREATMENT PLANT PROGRAM CONTINGENCY ACCOUNT OF THE 2013 -14 CAPITAL IMPROVEMENT BUDGET to the upper section of the exterior gunite (spray applied cementitious product) layer that is roughly 5 inches thick. There may also be a failure to at least one pre- stressed rod that may have triggered the gunite to delaminate. The top 3 to 4 feet of the SBT is damaged in at least one area. The pre- stressed rods are used to keep the tank wall in compression and are critical to the tank's structural integrity. Failure of the rods could result in the gunite delaminating and falling off. This tank is partially buried, roughly 35 feet tall (25 feet above grade), 63 feet in diameter, over 50 years old and is in very close proximity to equipment and process piping. Since the failure, staff has worked on the following: Contacted a structural engineer and performed an initial evaluation. The structural engineer assessment is that this failure has minimal impact to the overall structural integrity of the tank based on its current use and low liquid level. Therefore, the District can continue using it. 2. The SBT area has been secured for safety reasons. 3. Staff has contacted several specialty contractors, pre- stressed concrete tank inspectors, and builders. Initial budgetary pricing has been discussed. The SBT can stay in operation for now; however, due to immediate safety and operational concerns for equipment and personnel below the tank, staff believes that repairing this tank should be classified as an emergency. Additional rod failures can be extremely dangerous by allowing more gunite to detach and there is also a high likelihood of damaging the adjacent lime system. Failure to the lime system can put the plant process at risk. Due to the specialty nature of the work, only a specialty demolition contractor and pre- stressed tank builder can perform the work. Staff contacted W.C. Maloney, Inc., DN Tanks, contractors that specialize in this type of work, and they are available to start the work during the week of June 2, 2014. The current approach is to remove the failed section safely and protect the below equipment and piping, and continue with the tank assessment. Following assessment, the SBT needs to be stabilized for safety and short-term service. The long -term serviceability will be evaluated and a future capital project may or may not be required. COMMITTEE RECOMMENDATION: This matter was discussed at the Engineering & Operations Committee meeting held May 27, 2014. The Committee recommended that the Board declare an emergency. RECOMMENDED BOARD ACTION: Declare an emergency and ratify the General Manager's actions under Public Contract Code 22050 to direct W.C. Maloney, Inc., DN Tanks, and District forces to perform emergency repairs on the damaged Sludge Blending Tank located in the Treatment Plant. Approve a supplemental authorization for $200,000 to the Treatment Plant Program contingency account of the FY 2013 -14 Capital Improvement Budget.
