AS THE DATE AND TIME FOR A PUBLIC HEARING TO CONSIDER APPROVAL OF A LEASE WITH AGLANTIS, A PUBLIC BENEFIT CORPORATION, FOR THE COCO SAN SUSTAINABLE FARM OF A PORTION OF THE KIEWIT PROPERTY, AND CONSIDER DECLARING LAND AS CURRENTLY UNNEEDED Submitted By. Bailey General Manag r ISSUE: Prior to entering into any lease of real property owned by the District, the Board must conduct a public hearing at which the lease proposal shall be considered. Leased property must be deemed unneeded for District purposes during the term of the lease. RECOMMENDATION: Set April 17, 2014 at 7:00 p.m. as the date and time for a public hearing to consider (1) approving the proposed lease with AgLantis, a public benefit corporation, of the Kiewit Property (APN 159- 140 -051) for the COCO San Sustainable Farm Project (COCO San Sustainable Farm) for a term of up to ten years, and authorizing the General Manager or his designee to execute the lease; and (2) declaring the property as currently unneeded. FINANCIAL IMPACTS: None by this action. If, after conducting the public hearing, the Board approves the lease, CoCo San Sustainable Farm will receive approximately 14.8 acres of the Kiewit property for $1 per annum. ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the recommended public hearing date or may elect to choose a different date; however, a public hearing must be held and the property must be declared as "currently un- needed" if the lease is to be approved for less than ten years. BACKGROUND: The District owns a parcel known as Kiewit Property, which concluded a five -year operation as a clean fill site in May 2013. The Kiewit property (see Attachment 1 for a site map) is located between Grayson and Walnut Creeks, Highway 4, and Imhoff Drive adjacent to the District's wastewater treatment plant in Martinez, California. On October 3, 2013, the Board directed staff to pursue a lease agreement with CoCo San Sustainable Farm covering an approximately 14.8 -acre portion on the western side of the approximately 33 -acre Kiewit property for operation of N:\ADMINSUP\ADMIN \DIST- SEC \Position Papers\2014 \PP Set PH for Kiewit Prop 4 -03 -14 Draft.doc Page 1 of 2 POSITION PAPER Board Meeting Date: April 3, 2014 Subject. On November 7, 2013, the Board formed an Ad Hoc Committee to review the proposed terms of the agreement before being brought back to the full Board. The Farm proponents had originally partnered with the Earth Island Institute, but have instead formed a public benefit corporation in February 2014 named AgLantis with the following purposes stated in its Articles of Incorporation: • promoting the conservation and utilization of natural resources, especially public lands and recycled water, to enhance sustainable, healthy living; • providing education to the community that fosters sustainable living practices to reduce the negative environmental impacts of human activity and increase health; • deploying under - utilized natural resources to feed people and reduce nutritional poverty with sustainable agricultural and food web practices that protect the environment; • focusing efforts especially on augmenting pathways between schools, higher education and careers; • focusing especially on benefitting disadvantaged populations such: as at -risk youth, veterans, disabled, immigrants and /or those under - served; and • collaborating with, promoting and sponsoring programs that share these goals. Staff has been working with the Farm proponents and the Ad Hoc Committee to develop a lease agreement and is prepared to present this agreement on April 17, 2014. RECOMMENDED BOARD ACTION: Set April 17, 2014 at 7:00 p.m. as the date and time for a public hearing to consider (1) approving the proposed lease with AgLantis, a public benefit corporation, of the Kiewit Property (APN 159- 140 -051) for the CoCo San Sustainable Farm Project (CoCo San Sustainable Farm) for a term of up to ten years, and authorizing the General Manager or his designee to execute the lease; and (2) declaring the property as currently unneeded.
